지방자치단체 인사청문회 도입 및 운영 사례분석 = Analysis of a Case of the Introduction and Operation of the Confirmation Hearing System in a Local Autonomous Government - Focused on the Seoul Metropolitan Government -

국문 초록 (Abstract)

본 연구는 서울특별시를 사례로 선정해 지방차원의 인사청문회 도입과정과 실제 운영사례를 분석하고, 정책적 시사점과 개선방안을 제시하는데 목적이 있다. 서울시는 법령상 근거부재로 인해 사후검증이라는 우회적 형식의 인사청문회를 최초로 도입한 후 단체장과 의회 간 협약을 통해 인사청문회 제도를 운영해 오고 있다. 이러한 서울시의 인사청문회 도입 추진 및 운영사례 분석결과 다음과 같은 정책적 시사점을 제시했다. 첫째, 상위법상 근거를 도입해 제도적 안정성 보장이 필요하다. 둘째, 지방자치단체가 스스로 새로운 제도나 정책 도입을 위한 방안으로 법령상 근거가 없다 하더라도 단체장과 의회 간 원만한 합의가 있다면 얼마든지 도입이 가능함을 보여주는 사례이다. 셋째, 인사청문 절차 및 운영방법 등에 관해 지방자치법령 또는 각 의회의 회의규칙을 준용토록 함으로써 불필요한 논란과 갈등을 줄일 수 있다. 다만, 인사청문 결과에 대한 구속력 부여, 도덕성 검증 및 청문대상 등의 확대가 필요함을 개선과제로 제시했다.

다국어 초록 (Multilingual Abstract)

This study aims to analyze an actual case of the introduction and operation of the confirmation hearing system on the regional dimension and propose policy implications and improvement measures, selecting the Seoul Metropolitan Government as an example. Due to the lack of the legal grounds, Seoul has operated the confirmation hearing system through the convention between the head of the local government and the assembly since it first introduced the confirmation hearing system in an indirect type, the post-verification. As a result of an analysis of the case of Seoul’s promotion of the introduction and operation of the confirmation hearing system, this study proposed the following policy implications: First, it would be necessary to ensure the institutional stability by introducing higher-rank legal grounds. Second, this is a case that shows that it can be introduced by the local autonomous government s plan for the introduction of new systems and policies if there is an amicable agreement between the head of the local government and the assembly even if there are no legal grounds. Third, it would be possible to reduce unnecessary controversies and conflicts by asking local governments to apply the Local Government Act or the Meeting Rule of each assembly concerning the procedures and operating methods of the confirmation hearing. Yet, as tasks for improvement, it was suggested that it would be necessary to give a binding force to the result of confirmation hearing, verify morality and expand the subjects of hearing.
