사회보장법과 의회

국문 초록 (Abstract)

우리나라 사회보장법의 특성은 사회보장제도들의 핵심 사항들이 행정입법으로 통제되고 있다는 점이다. 입법권이 있는 국회는 사회보장법을 제정하지만 세부사항들에 대한 결정권한을 행정부에 대부분 위임하고 있다. 행정부는 이 위임권한을 기반으로 적용대상자, 급여의 조건, 급여의 수준 등과 같이 사회보장제도의 중요한 사항들을 시행령이나 시행규칙으로 통제하고 있다. 국회의 과도한 위임행태는 1987년 민주화 이전이나 이후나 크게 변하지 않고 있다. 그러나 민주주의체제에서 의회는 국민의 대변자이다. 따라서 국민의 삶에 중요한 영향을 미치는 사회보장제도에 대한 책임 있는 국회의 입법행태가 요구된다.

다국어 초록 (Multilingual Abstract)

A characteristic of the Social Security Acts is that all their important elements can be controlled through the decrees of the executive. The Nation Assembly has taken over the right to control them to the executive through a delegation form. Then the executive has been able to decide through decrees on the coverage of the programs, the premium of the social insurance, the conditions for entitlement, the scope and level of benefit etc.
This tendency has not been changed in spite of the democratization in 1987. In the young Korean democracy the regulation structure of the Social Security Acts is almost similar to that in the authoritarian regimes. The executive can still decide the important elements of the social security programs on the basis of the decrees. In democracy the state power belongs to citizens or the legislature as their representative organ. The legislature, therefore, should control these elements of the social security programs which effect on their life.
