영상물 등급분류제도의 법적 문제와 개선과제 = A Study on the Legislative Policies on Media Rating System Reform in Korea

국문 초록 (Abstract)

영상표현물에 대한 등급분류는 사회 통합적 성격을 반영한다. 따라서 등급분류제도는 사회 내지는 국가공동체의 가치를 통합적으로 구현하는 핵심적 기제로 작동하여야 한다. 민주화과정을 거치면서 수차례에 걸쳐 헌법재판소는 표현물에 대한 국가권력의 개입을 위헌으로 판결한 바 있다. 일련의 판결과 사회적 논란으로 우리사회는 국가권력과 시민사이에 공동체의 가치와 그 가치의 구현방안에 대한 합의를 마련해 가는 과정에 있다. 이것이 표현물에 대한 대응여부와 그 수준을 결정하는 데 있어서 더욱 큰 논쟁을 야기하고 있고, 그것이 영상물인 경우와 그 채널이 인터넷인 경우에는 합의과정에 더 큰 진통을 수반한다.
현행 헌법과 법률의 체계 내에서 그리고 우리 사회의 성숙도 정도와 사회적 가치의 충돌상황을 고려할 때 영상물등급위원회는 영상물이라고 하는 표현물을 통하여 제공되는 정보가 미성숙한 개체로서의 수용자에게 미치는 악영향을 최소화하기 위하여 수용자의 정보선택권을 보장하는 역할을 하여야 한다. 이를 위하여 등급거부제도의 도입, 전문성과 과학성 보강을 위한 소위원회 제도 개선, 민주성의 보장을 위한 배심원제 및 청문제도 도입, 미디어 환경변화에 따른 통합등급서비스 도입 등 다양한 과제를 추진할 필요성이 있다. 이러한 개선과제는 모두 영상물등급위원회를 제도적으로나 현실적으로나 시민사회의 신뢰를 받는 기관으로 탈바꿈하는 데 도움이 될 수 있을 것이다.

다국어 초록 (Multilingual Abstract)

The rating system on media has to reflect the social consensus. Therefore, the rating system functions as the core mechanism to realize the integration of the value of a society or a nation.
Several times in the process of democratization, the constitutional court ruled the intervention of state power as unconstitutional. The Korean society is right now at the middle of building up community values between state power and citizens and consensus on how to carry out these built constitutional values.
Within the constitution and current legal system and considering the Korean social maturity and the conflict among social values, KMRB(Korea Media Rating Board) functions to guarantee the right of information choice for customers in order to minimize the adverse effects of information delivered in the form of audiovisual to the minor.
For this sake, the legislations on the media rating system need to adopt diverse policies: the rating denial system, improvement of the subcommittee system for the reinforcement of professionalism and scientific approach, introduction of the jury system and the hearing system for the security of democracy, and introduction of the integrated rating system.
These policies will help change KMRB to become a more public trusted organization institutionally and actually.
