사이버성폭력과 규제 = On-line Sexual Harassment and Regulations

국문 초록 (Abstract)

인터넷의 확산으로 사이버공간에서 자유로운 정보 제공과 접근이 용이해지고 다양한 형태의 의사소통이 가능하게 되었다. 인터넷을 통한 의사교류의 긍정적인 측면 뒤에는 불법적이거나 유해한 정보의 확산이라는 부정적 측면도 공존한다. 사이버공간에서 특정인이나 불특정 다수를 성적으로 괴롭히는 행위를 사이버성폭력으로 규정하는데 본 논문에서는 이것의 정도, 피해, 사려에 대해서 논의하였다. 사이버성폭력은 상대가 원치 않는 성적인 언어나 이미지로 상대에게 불쾌감이나 위압감을 느끼게 하는 것을 말한다. 성과 관련된 표현으로 인한 사이버공간에서의 피해가 증가함에 따라서 규제 필요성에 대한 목소리가 높아졌다. 사이버 성폭력에 대한 규제로는 법을 통하거나 준행정기관을 통한 규제가 있고 인터넷 업체나 민간영역을 통한 자율규제가 있다. 본 논문에서는 다양한 형태의 규제를 검토하면서 사이버 성폭력 감소를 위해서는 어떠한 방식의 규제가 더 효율적인가를 검토하려고 하였다. 사이버성폭력은 오프라인에서와는 달리 문자나 영상 등의 표현을 통해 상대에게 피해를 주는 것이다. 이것에 대한 규제는 헌법이 보장하는 기본 권리인 표현의 자유 보장이라는 문제와 충돌하게 된다. 미국의 사려를 들면서, 사이버 성폭력에 대한 규제가 어떻게 표현의 자유를 규제하는 것으로 인식되는 지를 살펴보았다. 본 연구에서는 표현의 자유 보장과 매체로서의 인터넷의 특성을 고려할 때, 사이버 성폭력에 대한 규제로는 자율규제가 타율규제보다 바람직하다고 결론짓고 있다.

다국어 초록 (Multilingual Abstract)

Along with the expansion of internet networks, communication in the cyberspace has become freer and easier than ever before. Despite the bright side, it also contains the dark side such as the spread of unlawful and indecent information. In this paper, I discussed the definition of the on-line sexual harassment, the extent, examples. On-line sexual harassment is defined as an act making someone feel unpleasant or threatened through sex-related words and images. With the rising number of victims from the on-line sexual harassment, the need for regulation has increased. Two kinds of regulations are discussed; the regulation through law and the regulation through the efforts of internet service providers. In this paper, I examined which approach is more efficient for reducing the on-line sexual harassment. Unlike in the off-line, the offense on the on-line is done through words and image rather than action. Because of the nature of the offense, regulation of on-line sexual harassment is faced with the issue of limiting the freedom of speech, the fundamental right of the citizen. In reviewing the cases in the States, we observed how Americans perceive the regulation in conflict with the freedom of speech. Considering the nature of internet communication and the freedom of speech, I think the regulations through the efforts of internet service providers and users are more effective than through laws.
