The system of Development Restriction Area was introduced in January 19, 1971, after the revision of the Urban Planning Act. A development restriction area can be designated under related regulations for the purpose of preventing urban sprawl, preserving natural environment around a city, and securing sound living environment for citizens or in case that its necessity is recognized for the sake of security. However, such negative evaluations that the areas encroached on the green zones within a city or that they paid no attention to damage to property rights of the owners of lands within the areas have been continuously suggested. And at last, the Ministry of Construction & Transportation sweepingly deregulated the areas, and the deregulation is still under way. However, although diverse theories and policies have been presented for the current adjustment of development restriction areas, problems still occur successively. At this, the present study aims to compare with foreign cases and examine the present circumstances of development restriction areas in Hanam City and problems arising from their management; to propose more reasonable methods for improvement which are appropriate to changes in the urban environment of Hanam City; and thus to provide basic information on the formulation and implementation of policies related to the future development restriction area and city planning. As a result of this study, problems of the development restriction areas in Hanam City and their remedies can be summed up as follows:
First, system improvement is critical and necessary above all things so that responsible local governments empowered by laws can fulfil their roles adequately and effectively.
Second, urbanization effects are extremely limited due to the excessive creation of development restriction areas. And Hanam City and its citizens' groups are demanding the dissolution of development restriction areas so as to remedy the illegal diversion of land caused by such rigid regulations on land use. Remedies for such problems should be worked out.
Third, land form & nature alteration and illegal acts are increasing in Hanam City. They occur because leasing service yields more profits than the agricultural uses of land, even after paying a fine for illegal land use. Particularly, the illegal alteration of use from a cattle shed in Hanam City has been pointed out as a problem which should be remedied as soon as possible.
It is important to allow citizens to enjoy environmental rights as well as to pursue economical efficiency through dissolving development restriction areas. After all, when working out policies related to development restriction areas, the government needs to have an attitude to actively collect and reflect opinions from citizens in a relevant region and consider their basic right to live, as well as to pursue economical efficiency and publicness. That is, the adjustment of development restriction areas should be promoted from a long-term view in terms of the use of the whole national land. Above all things, it should be recognized that the efficient preservation and utilization of development restriction areas cannot be expected without cooperation from relevant local autonomous entities and residents within them. Therefore, the thorough investigation of actual conditions should be conducted during the adjustment of areas; and efforts for deriving national consensus, such as the widening of concerned parties' participation and the persistent promotion of policies, should be followed during the process of system improvement.
