자유무역협정의 반덤핑규정: 한국과 일본의 비교분석 = Antidumping Provisions of Free Trade Agreements: A Comparative Analysis of Korea and Japan

다국어 초록 (Multilingual Abstract)

This paper examines antidumping provisions in the FTAs of Korea and Japan. According to the previous researches, we can classify FTAs into three mutually exclusive groups: (1)those that prohibit the use of antidumping measures, (2)those that include some procedural and/or substantive requirement for antidumping measures, and (3)those that have no such prohibition and no specific provisions. The results of this paper found that Korea is adopting ``WTO-plus`` provisions, additional rules regarding the application of antidumping measures, in their FTAs. In contrast to the Korean policy, Japan`s FTAs are maintaining rights to impose antidumping duties in accordance with GATT Article Ⅵ and WTO Antidumping Agreement, which are ``WTO-equivalent`` provisions.
