2024년 보험법 중요판례평석 = Analysis of Major Cases on Insurance Law in 2024

국문 초록 (Abstract)

대한변협이 발행하는 유서 깊은 학술지인 ｢인권과정의｣는 매년 봄이면 법조 실무가들을 위하여 전년도에 선고된 중요 판례를 각 분야별로 선별하여 게재하고 있다. 이 판례평석은 2024년에 나온 보험법 관련 대법원의 판례들 중에서 중요한 것을 엄선하여 검토한 것이다. 작년의 경우 운송법 관련해서는 중요 판례가 나오지 않았다. 2024년의 경우 운송법이나 보험법에서는 많은 하급심 판례가 나왔지만 하급심 판례의 경우 대법원에서 그 결론이 뒤바뀔 수 있어서 여기서 취급하기는 곤란했다. 대법원 판례의 경우 사법정보공개포털에서 선별하여 발췌하였고 관련 하급심 판례는 LBOX에서 발췌 인용하였다. 소송과 판결의 토대가 되는 사실관계를 확인하기 위해서는 관련 하급심 판례를 인용 참조해야 한다. 대법원 판결은 법률심이기 때문에 사실관계를 충분히 기재하지 않는 것이 일반적이기 때문이다. 하지만 필자의 관점에 따라 중요 판례를 선별 분석하였기 때문에 논자에 따라서는 동의하지 않을 수도 있을 것이다.

This case commentary analyzes the most significant Supreme Court rulings on insurance law from 2024. Although numerous lower court decisions were issued in both transportation and insurance law that year, they were excluded due to the possibility of being overturned by the Supreme Court. To provide clearer factual context, relevant lower court rulings were cited from LBOX, as Supreme Court decisions typically focus on legal interpretation rather than detailed fact-finding. The selection and analysis presented here reflect the author’s perspective, and interpretations may differ.
