주요 국가의 장애인 의무고용제도의 변화 비교 = 한국, 일본, 독일, 프랑스를 중심으로

국문 초록 (Abstract)

본 연구는 주요 국가의 장애인 의무고용제도의 변화를 정책대상, 의무고용률과 고용의무 적용범위, 사업주 제재와 지원제도를 중심으로 비교하였다. 비교 결과, 한국은 비교국가에 비해 의무고용대상자 출현율이 낮고, 그 기준도 의학적 판정에 따르고 있어 근로능력 판정체계를 구축하고 직업적 장애인을 폭넓게 포괄하는 방식으로 정책대상자 정의를 합리화시킬 필요가 있다. 사업체 의무고용 적용범위를 확대하고, 법정 고용률을 상향 조정해 왔으며 의무고용이행률은 높으나, 한국은 비교국가에 비해 의무고용영향률 즉 전체 장애인 고용에 대한 기여도가 낮으므로 의무고용률의 상향조정이 필요한 것으로 나타났다. 모든 비교국가는 장애인 고용확대를 위한 사업주 제재조치를 강화시키는 추세이며 한국은 상대적으로 고용성과가 저조한 대기업의 고용의무 이행을 위한 사업주 제재 강화방안을 마련할 필요가 있으며, 사업주 지원제도는 독일과 프랑스와 같이 취업취약 장애인의 고용수요를 활성화시킬 수 있는 제도로 재설계될 필요가 있다.

다국어 초록 (Multilingual Abstract)

This study compares changes in the quota employment system for the disabled in major countries. It is necessary for Korea to rationalize the definition of policy subjects in a way that builds and broadly encompasses the work capacity determination system. In addition, the impact of employment on the disabled labor market is low compared to comparative countries, so an upward revision of the quota employment rate is necessary. All comparative countries are in the process of strengthening employer sanctions, and Korea needs to make arrangements for strengthening employer sanctions in order to fulfill the employment obligations of large corporations with relatively low employment performances. In addition, the financial support system for employers needs to be transformed into a system that can stimulate the employment demand of vulnerable people with disabilities such as Germany and France.
