법률의 총량 및 복잡성 증대 추세 분석 = Measuring the size and complexity of Korean law

국문 초록 (Abstract)

본 연구는 1985년부터 2015년까지 법률 총량 및 복잡성 증대 추세를 통계적으로 분석하였다. 우리나라 법률 체계는 2015년 기준으로 조문 6만 5천개, 글자 1,690만자, 법률 간 인용 및 하위법령 위임 수 각 4만여 회에 달하는 방대한 체계로 성장하였다. 30년 전에 비해 조문은 2배, 글자는 3배, 하위법령 위임은 5배, 법률 간 인용 수는 7배 이상 증가한 결과로서, 법률 총량보다 복잡성이 더 빠르게 증대되었다. 이러한 법률의 성장 속도는 동 기간의 미국 연방법전(USC)보다 빠른 것이며, 점점 가속되고 있다. 특히 2010년 이후에는 법률 총 글자 수가 연평균 6.7%씩 증가하고 있다. 이러한 성장세는 입법수요 증가에 따른 자연스러운 현상일 수 있으나, 정량적 입법 성과주의 등 비합리적 요인에 따른 것일 가능성도 배제할 수 없다. 법률의 총량 및 복잡성 증대는 법률 접근성을 저해하고, 법의 지배를 방해할 수 있으므로, 법령정비, 입법과정 개선 및 법령정보 제공의 지능화 등 대응 방안을 마련할 필요가 있다.

다국어 초록 (Multilingual Abstract)

This paper analyzes the increasing trend of the overall size and complexity of Korean law from 1985 to 2015. As of January 2015, the Korean law has about 65 thousand articles, 16.9 million words, 40 thousand citations of other laws and 42 thousand delegations to enforcement decrees and enforcement rules. Compared with January 1985, the number of articles increased by 2.2 times, the words increased by 3.7 times, the citations of other laws increased by 7.3 times and the delegations to enforcement decrees and enforcement rules increased by 5.4 times. For the last 30 years, legal interdependence increased more rapidly than the total amount of the law. In addition, Korean law, as a whole, is not only growing faster than the United States Code, but also accelerating in its growth rate. The longer and more complex the legislation evolves, its accessibility declines and rule of law is likely to fail. Therefore, the paper calls for measures to control the currently untamed quantitative expansion and augmenting complexity in order to secure the accessibility of law.
