Case Law Methodology and the Common Law as Comparative Law in Korean Law Schools

국문 초록 (Abstract)

2009년 3월3일에 한국은 미국식 로스쿨 시스템을 도입하였다. 정부는 법학전문대학원인가를 위한 필수조건으로 영어강의과목의 개설 및 일정 비율 이상의 실무교원확보를 내세웠다. 외국변호사의 고용을 요건으로 하고 있지는 않다. 그럼에도 불구하고 한국 및 한국교육의 세계화를 위하여 법학전문대학원인가를 위한 두 조건과 함께 외국변호사를 교수로 고용하고 있다. 그러나 외국변호사의 교수채용은, 비록 정부의 주된 의도는 아니지만, 세계화를 위하여 미래 한국 변호사를 비교법적인 학습이 가능하도록 한다.
이 논문은 미래의 한국변호사들이 미국 보통법에 대한 고찰을 돕기 위하여 작성되었다. 한국의 지리적위치와 수출지향적인 경제상황 때문에 미래의 한국 변호사들은 보통법 국가의 기업들과의 상호작용이 필요하다. 본 논문은 이러한 전제하에 작성되었다.
그러므로 본 논문은 한국의 법학, 법조, 그리고 로스쿨 학생들에게 보통법의 법학방법론을 제시하기 위하여 작성되었다. 이 논문은 미국 펜실베니아의 공공복리의 예외인 임의고용제도를 통하여 보통법적 사고와 어떻게 적용을 소개한다. 그러나 이러한 보통법은 대륙법체계하의 사람들에게는 다소 어리둥절하게 보일 수 있다.
보통법에 대한 이해를 통하여 대륙법계 법체계에서 보통법 시스템의 장점을 인식할 수 있다. 대륙법이 표준이고 다른 법체계는 비정상이라는 이분법적 생각에서 탈피시키고자 함도 본 논문의 목적 중 하나이다. 그러나 저자는 한국이 대륙법체계에서 보통법체계로 전환하거나 보통법의 계수를 촉진하는 것을 바라지 않는다. 다만, 보통법의 이해를 통하여 다른 법체계 국가와의 거래관계를 잘 해나기 바랄 뿐이다.
