이주노동자 자녀의 사회권에 대한 논쟁 = The Theoretical Debates on the Social Rights of Migrant Workers' Children

The purposes of this study are to examine the situations of the protection of the social rights of migrant workers' children in Korea and to discuss the obstacles to granting the social rights to the children. In addition, the study explores theoretical debates concerning the social rights of the children, comparing citizenship theories and human rights approach. The study also introduces new theories relating migrant workers and their families, such as global citizenship and multicultural citizenship. Global citizenship, which is mainly legitimated by international laws and conventions, goes beyond conventional citizenship and explores the possibility of transnational membership. Multicultural citizenship concerns with the recognition of the cultural identity and pride of minority groups. Its claim is that without the recognition, minority group can not be included as a part of its society. Based on the theoretical debates and concepts, the implications on the protection of the social rights of the migrant workers' children are discussed.

국문 초록 (Abstract)

본 연구의 목적은 우리나라의 이주노동자 자녀의 사회권 보장 현황을 파악하고 이주노동자 및 그 자녀의 사회권에 관련된 이론적 담론과 논쟁을 논의하는 것이다. 더 나아가 그 이론적 함의를 통해 사회권 보장방안을 모색하고자 하는 것이다. 본 연구는 사회권과 관련된 두 가지 이론적 시각, 즉 시민권적 접근과 인권적 접근을 통해 형성된 이주노동자 자녀의 사회권에 대한 담론을 살펴보고 그들의 사회권 보장에 있어서의 각 접근의 한계점을 알아보았다. 또한 세계화의 변화와 함께 이주노동자의 현실에 보다 더 접근한 새로운 이론적 개념으로서, 전 지구적 시민권과 다문화주의 시민권을 살펴보았다. 전 지구적 시민권은 국제협약이나 국제법을 근거로 권리를 부여한다는 점에서 기존의 인권적 관점과 비슷하지만 전통적 시민권에서 강조하는 소속감이나 통합의 개념을 전 지구촌으로 확대하자는 주장을 담고 있다. 다문화주의 시민권은 소수민족 고유의 문화 및 삶의 방식을 인정하는 동시에 각 집단이 처한 특수한 상황을 고려하여 집단마다 차별화된 권리를 부여하자는 개념이다. 본 연구는 이주노동자 자녀의 사회권 보장을 위해 우리나라의 문화나 상황을 고려할 때 인권적 접근이 시민권적 접근보다 현실적인 대안으로 판단하였다. 전 지구적 시민권이나 다문화주의 시민권 등이 주는 함의를 바탕으로 인권적 접근이 이주노동자 자녀의 사회권 보장에 보다 더 기여할 수 있는 방안을 논의하였다.
