국제물품매매협약상 위험부담의 의의와 고려요소

The United Nations Convention on Contracts for the International Sale of Goods(CISG) sets out rules as to risk allocation. The rules determine whether sellers or buyers are bound to bear the risk of accidental loss of, or damage to, the goods, and say that the buyer is liable for the price of the goods despite the fact that such loss or damage had occurred after the risk has been transferred to him.
In these regards, this paper defines the meaning of the risk in CISG, and examines the consequences of the transfer of risk and the retroactive reversion of it by the buyer's avoidance of contract or request for delivery of substitute goods.
CISG's risk rules should be assessed on the underlying pragmatic considerations: The loss or damage is usually discovered at the end of the carriage; the buyer usually is in a better position than the seller to assess the damage, make a claim against the third party including the insurer who is under liability to compensate, and salvage the usable goods, while it is customary for the loss in transit to be covered by insurance; the distributional justice should be achieved between the parties.
