저작권법상 대여권 개정 논의

국문 초록 (Abstract)

저작권법 연혁상 배포권은 복제, 발행 혹은 출판권의 한 내용이었으나 최근 독립하였다. 마찬가지로 대여권은 대개의 입법이 배포권의 한 내용으로 하되 최초판매이론에 따라 저작자의 권리 행사를 제한하였으나, 대여 시장의 발달에 따라 영리 대여를 규제할 수 있게 되고, 최근에는 음반, 프로그램, 영상저작물 등 인정 대상을 확대할 뿐 아니라 독립한 권리로도 인정하게 되었다. 우리 저작권법은 1994년 개정으로 음반과 프로그램에 한해 대여권을 도입하였으나 다음의 문제점이 있다. 첫째 대여 시장이 발달한 도서와 영상저작물에 대해 아무런 권리 규정이 없는바 대상을 확대하여야 할 것이다. 둘째 확대하는 경우 권리의 성질은 배타적 금지권으로 하여 이중가격제, 시차제 등 구체적인 행사방법은 시장 논리에 맡겨야 할 것이다. 셋째 음반의 경우 배포권자가 아닌 실연자에게 대여권을 인정하는바, 대여권은 우리 저작권법에서 독립한 저작재산권이 아니라 최초판매로도 소멸하지 않은 배포권의 한 내용이므로 이러한 모순을 정비하여야 할 것이다.

다국어 초록 (Multilingual Abstract)

In the earlier time of copyright law, the distribute right was not an independent right but a content of reproduction, publication or publishing. Likely, rental right is a content of distribute right but it is prohibited under first-sale doctrine. But as the phono-record or computer program rental shops flourish, copyright law authorized copyright owner to control commercial rental. Moreover, some legislations adopt rental right as independent right. Korean legislations adopted phonorecord rental right and computer program rental right in 1994. But there are some problems for reform. First there are no rental rights for books and movies although commercial rental shops are porsperous for them. Second, as the aspect of rental right for new items, the right should be authorized wholly not as right to ask money. Third, Korean copyrigh law has some inconsistensies. For example, performer does not have distribute right, and rental right is a content of distribute right. Nevertheless performer has rental right for phono-record.
