경기도 무형문화재 보호 조례 제정의 필요성과 방향

국문 초록 (Abstract)

이 논문은 경기도 무형문화재 보호 조례 제정의 필요성과 방향에 관한 연구이다. 이를 위해 지자체 조례의 상위법령인 문화재보호법과 무형문화재 진흥 및 보존에 관한 법률을 검토했고 대한민국이 가입한 유네스코 무형문화유산 보호협약 등을 들어 무형문화재 보호의 중요성을 살폈다.
이어서 향후 경기도 무형문화재 보호 조례의 방향에 대해 논의했다. 개정된 문화재보호법과 현행 문화재보호법의 무형문화재 부분을 비교하였고 ‘무형문화재 보전 및 진흥에 관한 법률’ 중 ‘제정의 필요성’과 중요내용을 제시하였다. 아울러 무형문화재 기록화, 무형문화재 기 · 예능보유자 및 보존단체 관리, 경기도 무형문화재 활용 및 활성화에 대해 논의했다.
아울러 이 논문에서는 경기도 무형문화재 보호 조례 제정의 방향에 있어 무형문화재에 대한 기록물의 종류, 형태, 공개범위에 대해 논의했다. 무형문화재를 발굴하고 조사하며 이를 기록할 수 있는 전문인력의 양성이 필요성에 대해 논의했다. 또한 무형문화재 기 · 예능보유자의 전승 및 교육활동, 무형문화재 기예능 공개에 관한 기록과 평가에 대한 기록물 관리의 필요성과 공개의 필요성에 대해 논의했다. 마지막으로, 무형문화재 관련 전문인력을 무형문화재 관련 부서에 배치하여야함을 주장했다.

다국어 초록 (Multilingual Abstract)

This paper is a study on the necessity of enacting Gyeonggi-do local Self-government Ordinance on intangible cultural heritage protection and on the future direction for enactment.
We study the importance of protecting intangible cultural heritages by observing the upper laws, Cultural heritage protection act and Act on promotion and protection of intangible cultural heritage, as well as UNESCO Convention for the safeguarding of the intangible cultural heritage. We claim the necessity of enacting Gyeonggi-do local Self-government Ordinance on intangible cultural heritage protection to discovering and utilizing intangible cultural heritages in Gyeonggi-do.
Then we suggest the future direction of Gyeonggi-do local Self-government Ordinance on intangible cultural heritage protection. We compared the revised Cultural heritage protection act with old act, and examine Act on promotion and protection of intangible cultural heritages. We discuss recording intangible cultural heritages, managing intangible cultural heritage expertises and conservation organizations, and promoting applications of intangible cultural heritages in Gyeonggi-do.
Also, we discuss which intangible cultural heritages will be recorded and should be open to the public, to help enacting Gyeonggi-do local Self-government Ordinance on intangible cultural heritage protection. We emphasize on fostering experts who can discover, research and record intangible cultural heritages. We also propose the necessity of managing documentaries on inheriting intangible cultural heritages from expertises to successors and on evaluating intangible cultural heritages, and the necessity of opening intangible cultural heritage to the public. We also claim to keep experts to departments related to intangible cultural heritages.
