빈용기보증금제도에 관한 비교법적 연구 = A Comparative Study on Container Deposit Legislation

Container-deposit legislation IS any law that requires collection of a monetary deposit on soft-drink juice milk, water, alcoholic-beverage and/or other containers at the point of sale. Container-deposit legislation aimed at cost-reduction at first, but took an important portion of was e recycling nowadays. In this article this writer tries to take a general view of introduction of container-deposit legislation and look at German container-deposit legislation and Danish container-deposit legislation, and then American container-deposit legislation, and lastly a proposal of revision on Korean container-deposit legislation. But container-deposit legislation of U.S.A is very different from that of European countries such as Germany and Denmark because U.S.A is no only different from European countries in spatial scale, but also different from European countries in social?political?economic system in two respects. Firstly recycling policy is not so developed in U.S.A as in Germany and Denmark because collecting cost, keeping cost and transporting cost exceed benefits of reusing. But disposable container-deposit IS developed in .S.A because it is very easy to keep and transport. Secondly Container-deposit legislation of a state is quite different from that of other states because U.S.A IS a federal state. Container-deposit legislation of U.S.A. IS emphasized In pecuniary incentive for collecting con ainer rather than use acceleration of reusing container. It is necessary to consider comprehensively in examining cases of foreign countries related to con ainer-deposit legislation. It is high time hat we should prepare a legal basis of a association of Korean circular container on Law on resource saving and reusing acceleration.
