    본 연구는 한국과 미국의 신원조사 제도에 대한 비교 분석을 통해 한국 신원조사 제도의 발전적 방향을 살펴보는데 목적이 있다. 이를 위해 법치주의 구현 및 기본권 보장을 위한 척도로서 비례성·적법절차·투명성의 원칙을 비교 분석 기준으로 설정하였다. 한미 양국의 신원조사 제도는 국가안보와 공공신뢰 보호라는 동일한 목적을 공유한다는 점에서 공통점이 있다. 그러나 비례성 측면에서 미국은 조사의 범위·강도를 체계적으로 차등화하고 있는 반면, 한국은 차등화의 구체적인 규정이 미비하다. 적법절차 측면에서 미국은 불복절차 등 법령에 명문화하여 실질적인 방어권을 보장하는 반면, 한국은 구체적인 절차적 권리의 규정이 미흡하다. 투명성 측면에서 미국은 심사기준의 공개와 다층적 외부감시 체계를 갖추고 있는 반면, 한국은 판정기준 및 절차에 관한 공개가 제한적이고 외부감시 구조가 취약하다. 이 같은 연구 결과를 토대로 한국 신원조사 제도의 발전을 위해 신원조사만을 다루는 개별 법률이나 대통령령 제정, 신원조사의 범위와 강도에 따른 비례성 원칙 준수, 대상자의 절차적 권리 개선, 투명성 제고를 통한 국민적 공감대와 신뢰성 학보 등을 제시한다.

    This study aims to explore developmental directions for South Korea's personnel vetting system through a comparative analysis of the personnel vetting systems in South Korea and the United States. To this end, the principles of proportionality, due process, and transparency were established as the comparative analysis criteria, serving as benchmarks for realizing the rule of law and guaranteeing fundamental rights. The personnel vetting systems of both South Korea and the U.S. share common ground in that they pursue the same goals: protecting national security and public trust. However, in terms of proportionality, while the U.S. systematically differentiates the scope and intensity of investigations, South Korea lacks specific regulations for such differentiation. Regarding due process, the U.S. explicitly codifies appeal procedures in its statutes to guarantee substantive rights of defense, whereas South Korea provides insufficient regulations for specific procedural rights. In terms of transparency, the U.S. discloses its adjudication criteria and maintains a multi-layered external oversight system, while South Korea offers limited disclosure regarding adjudication standards and procedures and possesses a weak external oversight structure. In light of these findings, this study proposes several measures for the development of South Korea's personnel vetting system: enacting individual legislation or presidential decrees dedicated solely to personnel vetting system, maintaining the principle of proportionality according to the scope and intensity of investigations, improving the procedural rights of subjects, and enhancing public consensus and institutional credibility through enhanced transparency.
