중국의 미성년자보호법의 개선방향에 대한 제안 -UN 아동권리협약과 한국과 일본의 아동학대 관련법 비교를 바탕으로- = Suggestions for the Amendment of the Law of the People's Republic of China on the Protection of Minors

다국어 초록 (Multilingual Abstract)

This study aimed to suggest directions for the amendment of the law on the Protection of Minors in China. For this goal, this study compared the law with the child maltreatment-related articles from the UN Convention on the Rights of the Child and the child maltreatment-related laws from Korea and Japan. Moreover, it compared the original law of the Protection of Minors established in 1991 with its revised edition in 2006 to estimate the levels and extent of the amendment. Based on the results, this study suggested the following directions for the amendment：1) furnishing the maltreated children with group homes and foster care, 2) establishing child protection agencies, 3) setting up occupational clusters of mandatory reporters and the legal foundations for educating them, and 4) the creation of supplementing articles related to the probation of offenders and the penalties for probation violation.

국문 초록 (Abstract)

한국과 일본의 아동학대 관련법 연구에 비해 중국의 아동학대 관련법에 관한 연구는 미비한 상황에서, 본 연구는 국제사회로부터 글로벌 스탠다드에 부합하는 인권기준을 수용할 것을 요구받고 있는 중국의 아동학대 관련법인 미성년자보호법의 개선방향을 제안하기 위하여 1) UN 아동권리협약과의 비교, 2) 한국과 일본의 아동학대 관련법과의 비교, 3) 1991년 제정된 미성년자보호법과 2006년 개정법과의 비교를 실시하였다. 연구결과를 바탕으로 본 연구는 중국의 미성년자보호법이 차후에 1) 공동생활가정이나 위탁양육과 같은 대체적인 양육환경의 제공, 2) 아동학대 전담기구의 설치, 3) 신고의무자의 설정과 교육, 4) 가해자에 대한 보호처분과 불이행에 따른 처벌을 명시할 것을 제안하였다.
