전략환경평가 도입에 따른 사전환경성검토와 도시관리계획 환경성검토 통합에 관한 연구 = (A)Study about the Integration of Pre-Environmental Review System on the Introduction of Strategic Environmental Assesment and Environmental Assesment System of the Urban Planning

다국어 초록 (Multilingual Abstract)

The established process of Urban Planning, it will be able to divide with setting up process and decision-making procedure. There are two process. One is Environmental Assessment System(EAS) for setting urban planning, the other is and Pre-Environmental Review System(PERS) in decision-making procedure.
Recently, It has decided an introduce of the Strategy Environment Assessment(SEA) which considered on environmental effects from establishing process of a policy and an administrative plan.
According to the similarity of SEA and PERS' purpose, it has decided to improve existing PERS for SEA's setting up.
Before an improvement of PERS, for the sake of formalities Urban Planning, there was an difficulty of time difference between run EAS and PERS.
While improving of PERS, if it was made a draft bill of administrative plan, an administrative structure would have to make out a draft bill of Pre-Environmental Review statement(PERs) for estimate a macroscopic environmental assessment with resident opinions which are collected.
On condition a draft bill of PERs it has discussed to a subcommittee and an administrative structure could hold an explanatory meeting to look for listen to resident opinions.
Then, an administrative structure would have to make out the original bill of PERs to being added on resident opinions.
The administrative structure has to make sure PERs with the Minister of Environment.
Therefore making out a draft bill of PERs is like setting up process of Urban Planning at the same time.
So, an office worker and an administrative structure has difficulties because there are examined PER and EAS of urban planning much the same significance. because there are much the same significance between PER and EAS.
Consequently, I propose a plan of integrating PERS and EAS for urban planning and making earlier a period enforcing of PERS to promote efficient system of PERS.

국문 초록 (Abstract)

도시관리계획의 수립절차는 입안절차와 결정절차로 구분할 수 있으며, 이러한 과정에서 계획에 대한 환경평가는 입안 절차시에 환경성검토와 결정 절차시에 사전환경성검토가 있다.
최근 정책 및 행정계획 등의 수립과정에서 환경적인 영향을 배려하는 전략환경평가제도의 도입·시행이 결정되었다. 전략환경평가제도의 시행목적과 사전환경성검토제도의 시행목적이 유사함에 따라 기존의 사전환경성검토의 개선을 통하여 전략환경평가제도를 시행토록 한 것이다.
도시관리계획 입안·결정 절차과정으로 볼 때, 사전환경성검토제도가 개선되기 전에는 계획에 대한 환경평가 부분에 있어 입안시에는 환경성검토가, 결정시에는 사전환경성검토가 시차를 두고 운영되어 왔다.
금번 사전환경성검토제도 개선으로 계획수립기관에서는 행정계획의 초안이 마련되면, 해당 계획안에 대한 거시적인 환경성을 판단하고 주민의견을 수렴하기 위해 사전환경성검토 초안을 작성하게 되었다. 또한, 초안으로 위원회의 검토를 받고, 주민설명회를 개최하여 계획에 대한 공중의 의견을 수렴 하게 된다. 이후, 공중의 의견을 포함하는 사전환경성검토 본안을 작성하고 이를 토대로 관계기관의 장과 협의토록 함으로써, 사전환경성검토 초안 작성의 시점이 도시관리계획 입안 시점과 동일해 질 수 있게 되었다. 때문에, 의미가 같은 두 제도가 같은 시점에서 검토하게 되어 사업자와 관계기관의 부담이 증가하게 되었다.
따라서 환경성검토와 사전환경성검토제도의 통합을 추구하는 방안을 제안하며, 통합방안의 효율성 증대를 위해 사전환경성검토제도의 협의시기를 계획수립단계로 앞당기는 방안을 제시한다.
