소방시설 자체점검 조치명령 이행확인제도의 개선에 관한 연구

현대사회의 발전은 건축물의 대형화와 복잡 다양성을 불러왔다. 사회가 발전하면서 국민들의 안전에 대한 욕구는 점차 증가하고 소방서비스의 전문성과 다양성을 적극적으로 요구하고 있으나, 매년 대형화재로 많은 인명피해와 재산피해가 증가하고 사회적인 이슈로 대두되고 있다.
소방시설 등 자체점검의 문제점에 대한 대안은 지속적으로 제시되고 있지만 자체점검 결과에 따른 불량 소방시설 등의 조치와 이행에 대한 연구는 미흡한 편이다. 소방시설관리업체 등 민간에서 자체점검을 완벽하게 실시하여 자체점검결과보고서를 소방관서에 제출하였더라도 불량사항에 대한 이행확인 제도가 체계화 되어 있지 않으면 자체점검 자체가 무용지물일 것이다.
본 연구에서는 소방시설 자체점검 조치명령 이행확인 제도의 문제점에 대해소방시설법, 자체점검대상, 소방조직 및 인원 등의 자료를 분석하여 결과를 제시하였다.
소방시설 등 자체점검결과에 따른 조치명령 이행확인 제도를 효율적으로 운영하기 위해서는 다음과 같은 문제가 해결되어야 한다.
첫째, 자체점검결과 조치명령부터 이행확인까지의 세부적인 절차를 소방청 훈령이나 지침이 아닌 소방시설법령에 포함시켜 체계화함으로서 조치명령 이행을 확보해야 한다.
둘째, 자체점검대상은 법 개정으로 지속적으로 증가하고 있지만 자체점검대상을 체계적으로 관리할 조직과 인력은 이에 비례하지 못하는 현실로 각 소방관서에 자체점검 업무를 전담 할 부서 신설이 필요하다.
셋째, 소방공무원 교육과정을 운영하고 있는 소방학교의 경우 여러 분야의 교육과정을 운영하기 때문에 예방업무에 특화된 교육과정을 제공하기 어려운 현실이므로 예방전문 교육기관을 신설하여 전문요원을 양성해야 한다.
넷째, 예방업무 담당자의 전문능력을 향상하기 위한 교육과정이 부족하므로 많은 인원이 언제든지 교육을 받을 수 있도록 외부위탁 사이버교육과 외부 전문기관 위탁 교육을 확대해야 한다.
자체점검 업무는 관계인의 자율소방안전관리체계 확립에 큰 비중을 차지하고 있다. 소방관서 주도의 예방행정은 한계가 있으므로 민ㆍ관이 함께 상호 부족한 부분을 보완해 가면서 소방안전을 위해 노력한다면 국민의 소중한 생명과 재산을 보호하는데 중대한 역할을 하게 될 것이다.

The development of modern society caused the enlargement, complex and diversity of the buildings. Huge losses of life and property due to large-scale fire are increasing every year and coming to the fore as social issue though the desire for the safety of the people is gradually increasing and the professionalism and diversity are actively requested with the development of the society.
The alternative for the problem of the in-house inspection on the fire-fighting systems and so on is continuously suggested, but the research for the measures and implement on faulty fire-fighting systems and so on according to the result of in-house inspection is insufficient. In-house inspection itself is a useless thing when the confirmation system for the implementation on faulty items is not systemized though the in-house inspection is completely performed by private sector such as fire-fighting system management business and so on and submitted the in-house inspection result report to the fire station.
The analysis result for the data on the Fire-fighting Systems Act, subject of in-house inspection, fire-fighting organization and the number of the people and so on for the problem of the confirmation system for the implementation of order to take measures according to the in-house inspection on the fire-fighting systems is suggested in this research.
Following problems should be solved to operate the confirmation system for the implementation of order to take measures according to the in-house inspection on the fire-fighting systems.
First, the order implementation should be secured by systemizing detailed procedure from the order to confirm the implementation of the in-house inspection result by including in the Fire-fighting Systems Act not in the instruction or guideline of the National Fire Agency.
Second, new establishment of the department take part in the works for in-house inspection in the fire station is necessary due to the reality the organization and people managing the subject of in-house inspection systematically are not proportional though the subject of in-house inspection is gradually increasing by the revision of the Act.
Third, expert should be trained by newly establishing professional training organization for prevention because the fire-fighting school operating the training course for fire officer is operating several training courses, so it is difficult to provide specialized training course for prevention work.
Fourth, external commissioned cyber training and external professional organization commissioned training should be expanded to make many people can get the training at any time because the training course to improve professional ability of the person in charge of prevention work.
In-house inspection work is taking great part of the establishment of self fire-fighting safety management system of the party concerned. It will have a great role to protect precious life and property of the people if the public and private together do their best for the fire-fighting safety supplementing the part mutually insufficient because there is a limit on the prevention adminstration leading by the fire station.
