중국의 지적제도와 지적측량의 변화에 관한 연구 = A Study on the Development of Cadastral System and Cadastral Survey in China

다국어 초록 (Multilingual Abstract)

The number of research on the Chinese cadastral system is limited compared to neighboring countries such as Taiwan and Japan. In order to understand the Chinese cadastral system, the change of cadastral survey and cadastral system has been investigated. The main contents of this research includes the origin of land registration in China, the historical changes of cadastral act and cadastral organization has been investigated from the establishment to present times. The main findings of this research the cadastral Act in China has been developed in the form of legality and rationality.
The cadastral organization has been changed from the ministry of national land and resource to ministry of nature resource in charge of cadastre and land registration since 2018. Regarding the cadastral investigation, it is more related on the title investigation process and the items are more various unlike Korea. However the regulations and methods of cadastral survey is similar with Korean.

국문 초록 (Abstract)

중국의 지적제도는 대만과 일본에 비하여 인접국임에도 불구하고 소개와 연구가 이루어지지 않은 편이다. 본 연구에서는 중국의 지적시스템을 이해하기 위하여, 우선 지적제도와 지적측량의 변화에 대하여 고찰하였다. 주 연구 내용으로는 중국 토지등록의 성립 기원 등 역사 속에서의 변화 내용과, 지적관련 법령 및 관장 기구의 변화를 창설기부터 현재에 이르기까지 그 변화 내용을 고찰하였으며, 현재의 지적조사규정에 의한 지적조사와 지적측량 등 중국 지적조사 전반에 걸쳐 그 내용을 소개하고자 하였다. 그 결과 지적 관련 법령 들은 합법성과 합리성을 갖춘 형태로 발전 변화 하였으며, 지적 관장 기구는 2018년 국토자원부에서 자연자원부로 개편하여 자연자원확권등기국에서 지적과 등기를 관리하는 것으로 변화되었다. 지적조사에 있어서 우리나라와 달리 권속조사의 비중이 크며, 조사내용도 다양한 편이고, 지적측량의 규정 및 방법은 우리나라와 유사한 것으로 나타났다.
