For many years, we have problems in relation to regulatory compliance and enforcement. One of the reasons is that regulatory standards are set at unreasonably strict levels. Also, regulatory drafting styles give large rooms of discretion to public officials. Unrealistic regulatory standards necessarily lead to low levels of compliance, while extensive bureaucratic discretion means little confidence in the impartiality of enforcement. As a results, regulated firms direct their efforts into circumventing enforcement activity, rather than attempting to comply with regulated standards.In the mean time, a focus on compliance is increasingly seen as a means of ensuring regulatory effectiveness. So, the adoption of explicit policies on compliance is widespread in OECD countries. In Korea, a key direction of the current regulatory reform has been to emphasize the feasibility of compliance with regulation. As a result, forty-four regulations out of 22 central ministries and agencies were examined for their compliance in 2002.Unfortunately, due to the lack of fund and understanding of the survey, it was not property conducted in many cases. Problems are found in the areas of constructing questionnaires, extracting samples, and utilizing results, etc.In order to cope with the problems, following suggestions are recommended:1. Priortizing regulations based on their need for compliance survey to maximize the utilization of limited resources.2. Specifying the contents of the regulatory compliance suvey to accomodate the unique situations of individual regulations.3. Generating productive information that can be useful for making and implementing regulatory policies.
