분쟁도서 주변수역 해양과학조사 시설물 설치에 관한 해양법적 연구 = Study on the Installation of Marine Scientific Research Facilities in the Overlapping Area around Disputed Islands in the Law of the Sea

국문 초록 (Abstract)

최근 한국은 독도 주변에 해양과학연구기지를 건설하려고 하였다. 그러나 독도가 서기 512년부터 국제적으로, 지리적으로 그리고 역사적으로 한국의 고유영토 임에도 불구하고 일본은 독도에 영유권 대한 주장을 여전히 지속하고 있다. 따라서 이러한 배경을 근거로 한국은 이 문제에 관한 일본의 주장에 대하여 반박할 수 있는 법적인 근거를 시급히 마련할 필요가 있다. 이러한 이유로 본고에서는 한국정부의 독도 주변 해양과학연구시설 설치에 대한 일본 정부의 제기 가능한 법적 문제에 어떻게 대응해야 하는가의 문제를 다루게 된다. 이러한 연구결과 본고는 유엔해양법협약, 국가관행 국제판례 등을 기초로 독도 주변 해양과학연구기지 설치에 대한 한국정부의 의사결정에 대한 법적, 이론적 및 논리적 근거를 제시하게 되며, 동시에 한국이 일본과의 향후 독도 주변 해양과학연구기지 설치에 관한 분쟁이나 갈등 유발시 체계적으로 대응하게 하는 근거를 제공한다.

다국어 초록 (Multilingual Abstract)

Recently, South Korea tried to build a marine scientific research facility around Dokdo. However, Japan is still claiming sovereignty over Dokdo even if Dokdo is an inherent territory of Korea since 512 AD internationally, geographically and historically. So, South Korea urgently needs to prepare legal grounds against the possible argument of Japan on that matters.
For that reason, this paper is dealing with how South Korea has to response on legal issues which might be raised by the Japanese government in accordance with the installation of the marine scientific research facility around Dokdo by the Korean government.
Therefore, this paper will suggest legal, theoretical and logical grounds in making decision and promoting of the Korean government on the installation of marine scientific research base around Dokdo based on the UN Convention on the Law of the Sea, State Practice and International Judgments, and at the same time, it makes possible for South Korea to systematically respond on anticipated conflicts or disputes on the installation of marine scientific research base or facilities around Dokdo in the future.
