Modern society has become increasingly dense and three-dimensional, and the Cultural Utilization of underground space has been expanded through the construction of large-scale underground infrastructure such as the GTX. Active utilization of underground space is significant in that it can respond to the growing demand for land use while overcoming the limitations of surface-oriented land utilization.
Notwithstanding the increasing necessity for the utilization of deep underground space for public purposes, Article 212 of the Korean Civil Code merely stipulates that "Ownership of land affects the upper and lower sides of land within the limits of a legitimate profit." without presenting any specific criteria for determining the scope of such legitimate profit. Consequently, whether deep underground space falls within the scope of land ownership or may be utilized for public purposes has been determined on a case-by-case basis, causing delays in public projects and social conflicts.
In addition, although the necessity of utilizing deep underground space has continuously increased, the current cadastral system registers and manages land only on a two-dimensional parcel basis. Accordingly, deep underground spaces cannot be registered or publicly disclosed as independent rights spaces, making it difficult to clearly determine the vertical scope of land ownership and to reflect rights relating to underground space in cadastral records.
This manuscript examines the legal issues concerning deep underground space and land ownership together with the structural limitations of the present cadastral system. Furthermore, it looks into the necessity of introducing a three-dimensional cadastre as an institutional basis for determining the ownership scope of deep underground space and proposes legal and institutional improvements for the registration and management of three-dimensional rights spaces through amendment of the act on the establishment, management, etc. of spatial data.
