At the same time, it clarified that even where the underlying factual circumstances remain the same, an addition or alteration of grounds is not permissible if changes in the normative evaluation or the legal basis of the disposition require a modification of its original content. The Court further held that, in litigation challenging a refusal disposition, an additional ground may be considered regardless of the identity of basic facts where the affected party has expressly consented to such consideration.
    The permissible scope of adding or altering grounds for an administrative disposition lies at the intersection of several competing values, including the duty to state reasons under the Administrative Procedures Act, the protection of the affected party’s right to defense, procedural economy, and the goal of resolving disputes in a single proceeding.
