지방자치단체 출자·출연기관 관리제도의 한계와 개선방안 = The Institutional Characteristics and Constraints of Local Government-Invested and Funded Authorities(LIFAs) Management System in Korea

Law of Foundation and Management of Local Government-invested and funded Authorities(LIFAs) instituted in 2014 replacing Law of Local Government Corporations has changed the nature of LIFAs in Korea. In this point, We are to inquire into the constraints of LIFAs` management system, and then make some recommendations. Local Governments have established diverse LIFAs, but there is no law for consistently regulating the authorities that LIFAs are considered as black box in Local Public Sector in Korea. In this respect, the new law has the significance of enabling the rationalization of establishment and management of LIFAs. But the institutional frame of the LIFAs stipulated on the law has many constraints such as overlap of managerial forms of LIFAs with local government corporations, inconformity of some provisions to the intent of the law, possibilities of political distortion and abuse of the regulations. We made some recommendations such as revision and merger of the laws of LIFAs and Local Government Corporation, clear stipulation of governance structure including the executives and the board of directors, systemization of feasibility study, separation and independence of the Deliberation and Resolution Commission, enriching the substance of the management evaluation and diagnosis of LIFAs.
