Academic fields have traditionally been regarded as relatively free from direct state regulation in order to guarantee academic freedom and respect academic autonomy. Accordingly, academic communities have developed research ethics as a body of norms for self-discipline and autonomous mutual control. In contemporary research, however, research ethics can no longer be regarded solely as an internal norm of academic communities, given the large-scale investment of public funds and the far-reaching effects of research outcomes on the state and society as a whole. As research ethics provides a normative foundation for sustaining public expectations of and trust in academia, it should be understood as a regulatory system closely connected with the public interest.
The necessity of regulating research ethics, however, does not in itself justify direct state regulation. The conduct of research and the dissemination of its outcomes are protected by academic freedom. Academic freedom, as a subjective public right—or defensive right—limits direct and unilateral state intervention, while, as an objective and public-interest-oriented value order, it simultaneously requires the state to establish an institutional foundation for safeguarding research ethics. The state is therefore confronted with a structural dilemma between the limits of direct intervention in academic affairs and its public responsibility to ensure research ethics. Consequently, the regulation of research ethics does not take the form of a uniform command-and-control regulation. Rather, it develops as an indirect and cooperative form of governance in which the state, academic institutions, and researchers share responsibility for norm formation, institutionalization, compliance assurance, and ex post control.
This study applies the theory of self-regulation as an analytical framework for interpreting research ethics governance from a public law perspective. Self-regulation, as used in this study, refers to a regulatory system in which regulated private actors assume the primary regulatory role through cooperation with the state in pursuit of specified public-interest objectives, while the state manages and supervises the system to ensure that it remains consistent with the public interest. For self-regulation to function as a form of public regulation, it requires autonomy, the pursuit of the public interest, and constitutional restraint as normative conditions, together with public-private partnership and the use of soft law as policy instruments and institutional foundations for implementation.
Research ethics governance appears structurally consistent with these conditions of self-regulation in that it involves the autonomous formation of norms and mutual control within academic communities, the public character of research outcomes, and the use of guidelines and other forms of soft law. It is not sufficient, however, merely to identify self-regulatory elements that exist in appearance. These existing elements must be incorporated into a public law framework, and self-regulation must be embedded in research ethics governance so that academic autonomy is guaranteed while being harmonized with the public interest.
In other words, the institutional reconciliation of the autonomy protected by academic freedom with the public-interest demand to safeguard research ethics may be achieved by embedding self-regulation within research ethics governance. This approach may provide the foundation for establishing a sustainable regulatory system capable of responding to rapidly changing contemporary research environments, including the growing use of generative AI.
