      헌법재판소법상 재판소원 금지규정에 대한 연구

      Korean Constitutional Court Act, Article 68, Clause 1 prohibits the petition with regard to only the trial of the court. It is prescribed as unconstitutional regulation by five reasons as follows. Therefore, the part of ‘Excepting the trial of the court’ in the above act should receive simple decision of unconstitutionality or be eliminated.
      First, considering Korean constitutional history, the people’s basic rights can be violated by judicial power, namely the trial of the court. Therefore, when the people’s basic rights are violated by the trial of the court, it is the essence of petition system to be secured the people’s basic rights through petition system. Therefore, prohibition of the petition to the trial of the court is against the essence of petition system. And when the petition is instituted on the basis of Constitutional Court Act, Article 68, Clause 1, it is possible to claim the principle of subsidiarity only when control of the trial of the court is premised. Therefore, the prohibition of the petition in the text of the above act is against the principle of justification of system. In addition, the purpose of constitution, article 111, clause 1 and issue 5 is to prescribe objects, conditions and procedures of the petition as legislation, considering the essence, purpose and function of petition system. Therefore, prohibition of the petition is against the above regulation.
      Second, legislative power, administrative power and judicial power, namely the trial of the court, are included in public power. Therefore, it is to recognize discriminative special right of the judicature without rational reason to exclude only the trial of the court from the object of the petition in Constitutional Court Act, Article 68 and Clause 1. Therefore, it is against the right to equality in the constitution, article 11.
      Third, the prohibition of the petition in Constitutional Court Act, Article 68 and Clause 1 makes the people not claim the government to make extensive and effective means to relieve their basic rights when the basic rights are violated by the trial of the court. Therefore, it violates the right of access to courts.
      Fourth, the Constitutional Court is a constitutional agency judging only parts related to analysis of the constitution out of the trial of the court, and the court has trial findings and matter of law as its main duty. Therefore, it is not to violate the position or authority of the Supreme Court and is not the problem of instance that the Constitutional Court judges the trial of the court violating the basic rights. Therefore, permission of the petition to the trial of the court is not against the principle of division of powers.
      Fifth, if permission of the petition to the trial of the court causes a congestion of the petition, the problem will be settled when the strict analysis standard related to the pertinent scope and judgment standard of the petition is set up and when diverse plans in constitutional policy are made. Therefore, it is not reasonable to prohibit the petition to the trial of the court because of the above problem.
