This paper is a Korean translation of “Foucault, Feminism, and Sex Crimes”(Hypatia Vol. 24 No. 4, 2009, pp. 1-25) written by Chloë Taylor, a Professor of Women’s and Gender Studies at the University of Alberta in Canada.
Although she focuses on the North American context and primarily engages with North American political and academic debates, her awareness that concerns about crimes, especially sex crimes, leading only to an expansion of the logic of the prison is also valid in South Korea. Therefore, her methodology, a new Foucauldianfeminist approach to sex crimes may have implications for us as well. This is precisely why I translated her article into Korean.
Except for the Introduction, the paper consists of the following sections:
- Feminism, Crime, and Punishment,
- Producing Recidivism,
- Sex Offenders,
- A Fragment of a Genealogy of Rape,
-Feminist Critiques of Foucault’s Proposals for Legislative Reform,
- Taking Rape Seriously,
-Conclusions: a New FoucauldianFeminist Approach to Sex Crimes.
The following abstract is included on the first page of the article:
“In 1977 Michel Foucault contemplated the idea of punishing rape only as a crime of violence, while in 1978 he argued that noncoercive sex between adults and minors should be decriminalized entirely. Feminists have consistently criticized these suggestions by Foucault. This paper argues that these feminist responses have failed to sufficiently understand the theoretical motivations behind Foucault’s statements on sexcrime legislation reform, and will offer a new feminist appraisal of Foucault’s suggestions.”
