    미주인권재판소는 2025. 6. 12. ‘돌봄권의 보호영역과 다른 권리들과의 관계’에 관한 권고적 의견을 냈다. 전 세계적으로 공적 가치로서의 돌봄에 대한 논의가 진행되고 있는 가운데 나온 이번 권고적 의견은 권리의 객체로서의 돌봄을 인정한 첫 번째 국제재판소의 의견이라는 점에서 역사적인 의미가 있다. 이번 권고적 의견은 돌봄권이 미주인권협약상 독자적인 보호영역을 가지는 인권임을 분명하게 밝히고 그 보호영역이 무엇인지, 종래의 미주인권협약상 인권과 어떠한 관계가 있는지를 매우 상세하게 밝혔기 때문에 법리적으로도 큰 진전이다. 미주인권재판소는 돌봄은 인간 존엄에 대한 존중의 직접적 표현으로서 존엄한 삶에 필수불가결한 요소이지만, 종래의 인권만으로 효과적으로 보장될 수 없고, 종래 인권 중 돌봄권의 보호영역을 모두 포섭할 수 있는 인권은 없다는 이유로 돌봄권을 독자적인 인권으로 인정하였다. 미주인권재판소는 돌봄권의 보호영역으로 신체적, 영적, 정신적, 문화적 측면에서 좋은 삶을 누리기 위해 ‘돌봄을 받을 권리’, 돌봄을 베푸는 사람의 신체적, 영적, 정신적, 문화적 측면의 좋은 삶이 유지되는 가운데 ‘돌봄을 베풀 권리’, 돌봄을 받는 사람과 돌봄을 베푸는 사람 모두 자신의 신체적, 정신적, 감정적, 영적, 문화적 측면에서의 좋은 삶을 추구할 수 있도록 ‘스스로를 돌볼 권리’의 셋을 구체화하였다. 미주인권재판소에 따르면 돌봄노동의 불평등으로 인한 여성에 대한 차별을 포함한 여러 차별 상황들은 돌봄을 받을 권리, 돌봄을 베풀 권리, 스스로를 돌볼 권리의 시각에서 효과적으로 드러나고, 차별을 시정하기 위한 구체적인 국가의 조치의무도 분명하게 파악할 수 있다. 미주인권재판소는 일할 권리, 사회보장에 관한 권리, 건강권, 교육권을 돌봄권의 관점에서 조명함으로써 국가의 돌봄 의무의 내용을 구체화하였다. 미주인권재판소의 권고적 의견은 돌봄이라는 가치를 우리 헌법상 어떻게 구조화할 것인지에 관해서도 큰 시사점을 준다. 미주인권재판소와 유사한 논리로 우리 헌법 제10조와 돌봄 사이의 필연적 밀접성을 주장할 수 있고, 이는 돌봄이 헌법상 가치라는 결론을 지지한다. 우리 헌법은 인간다운 생활을 할 권리에 관한 규정, 건강에 관한 국가의 보호 규정, 신체장애자 등에 대한 국가의 보호 규정 등을 두고 있지만, 이러한 규정들 각각은 돌봄권의 보호영역을 온전히 포섭하지 못할 뿐 아니라, 종래의 규정들 모두에 포섭되지 않는 돌봄권의 고유한 보호영역도 있으므로 돌봄권을 기본권으로 보장해야 한다는 논거 역시 이번 결정을 통해 힘을 얻게 된다. 나아가 기본권으로서의 돌봄권의 보호영역을 구체적으로 어떻게 설정할 것인지, 돌봄권을 통해 다른 기본권이 어떻게 더 잘 보장될 수 있는지에 관해서도 미주인권재판소의 이번 결정은 선명한 청사진이 될 수 있다.

    The Inter-American Court of Human Rights issued an advisory opinion on June 12, 2025, on ‘the content and scope of the right to care and its interrelationship with other rights’. Issued amid growing global discussion of care as a public value, this advisory opinion is historically significant in that it is the first opinion of an international court to recognize care as an object of human rights. It also marks a major advance in legal doctrine because it clearly states that the right to care is a human right with an independent scope under the American Convention on Human Rights, and specifies in great detail both the content of that protective scope and its relationship to existing human rights under the Convention. The Court recognizes the right to care as an independent human right on the grounds that care is a direct expression of respect for human dignity and an indispensable element of a dignified life, yet cannot be effectively guaranteed through existing human rights alone, and that no existing human right fully encompasses the entire scope of the right to care. The Court specifies three components of the scope of the right to care: the right to receive care, so that a person may enjoy well-being in physical, spiritual, mental, and cultural aspects; the right to provide care, so that caregivers may provide care while maintaining their own well-being in physical, spiritual, psychological, and cultural aspects; and the right to self-care, so that both care recipients and caregivers may pursue their physical, psychological, emotional, spiritual, and cultural well-being in their own way. According to the Court, various forms of discrimination -including discrimination against women arising from inequalities in care work- are effectively brought to light from the perspective of the right to receive care, the right to provide care, and the right to self-care, and the state’s specific obligation to take measures to remedy such discrimination also becomes clearer. The Court also clarifies the content of the state’s duty to care by illuminating the right to work, the right to social security, the right to health, and the right to education from the perspective of the right to care. The advisory opinion also has major implications for how the value of care should be structured under the Korean Constitution. Following reasoning similar to that of the Court, one may argue for the close connection between Article 10 of the Korean Constitution and care, which supports the conclusion that care is a constitutional value. Although the Korean Constitution contains provisions regarding care, such as the right to a life worthy of human dignity, state protection of health, and state protection of persons with physical disabilities, these provisions not only fail to fully encompass the scope of the right to care, but there also remains a distinctive scope of the right to care that is not covered by any existing provision. For that reason, this decision further strengthens the argument that the right to care should be guaranteed as a constitutional right. Furthermore, the Court’s decision may serve as a clear blueprint for how to define the specific scope of the right to care as a constitutional right and how other constitutional rights may be better guaranteed through the right to care.
