    국제인권법상 인권침해 피해를 입은 사람은 효과적인 구제를 받을 권리를 가지며, 국가는 피해자가 국내법절차를 통하여 그러한 구제조치를 제공받을 수 있도록 보장할 의무를 지닌다. 인권침해가 사인에 의하여 행해진 경우 이는 국내법절차 내에서 주로 민사상 불법행위 사건으로 다루어지게 될 것이므로, 민법은 국제인권법상의 국가의무가 국내법체계를 통하여 실현되는 중요한 장이기도 하다. 그러나 현재 국내법상 인권침해에 대한 구제조치 제도와 실무는 국제인권규범상 피해자의 권리를 효과적으로 보장하고 있다고 보기에 부족한 점들이 있다. 물권과 지식재산권 등의 권리 침해에 대한 구제조치는 민법과 특별법을 통하여 상대적으로 두텁고 다각적으로 보장되어 있는 반면, 인권침해에 대한 민법상 구제수단은 원칙적으로 사후적 금전배상으로 한정되어 있으며, 명예훼손 사안을 제외하고는 원상회복조치가 허용되지 않고, 법원의 해석에 의하여 인격권 침해에 대한 금지청구권이 일부 인정되고 있는 상황이다. 국제인권규범이 요청하는 신속하고 적절하며 효과적인 피해회복을 위하여 인권침해에 대한 원칙적 구제조치로서의 원상회복, 계속 중인 침해행위나 상태에 대한 중지와 시정, 피해구제에 적합한 방식으로 세밀화된 만족적 조치, 장래 예견되는 침해에 대한 예방과 재발방지조치가 복합적, 연속적으로 이루어질 수 있도록 국내법제도를 정비하고 실무를 발전시켜 갈 필요가 있다. 이를 통해 국제법과 국내법, 공법과 사법 간의 이분법적 접근을 넘어 국제인권법-헌법-민법 간 보다 유기적이고 통합적인 규범적 연계와 상호발전이 가능해질 수 있을 것이다.

    Under international human rights law, a person who has suffered a human rights violation holds the right to an effective remedy, and the State bears the obligation to ensure that such remedies are made available through domestic legal procedures. Where the violation is committed by a private actor, it will ordinarily be addressed within domestic proceedings as a civil tort case. Accordingly, private law—particularly the law of torts—constitutes a central normative site through which the State’s international human rights obligations are implemented within the domestic legal order. However, the existing framework and practice governing civil remedies for tortious conduct reveal significant shortcomings when assessed against the requirement to effectively guarantee victims’ rights under international human rights standards. While the Civil Code and special statutes provide relatively robust and diversified remedies for infringements of property rights—including rights in rem, contractual claims, and intellectual property rights—civil remedies for human rights violations remain largely confined to ex post monetary compensation. Except in cases of defamation, restitution in kind is generally not permitted, and injunctive relief for infringements of personality rights has been recognized only in limited circumstances through judicial interpretation. In order to meet the international human rights requirement of prompt, adequate, complete, and effective reparation, it is necessary to reform domestic legal institutions and further develop judicial practice so that multiple and mutually reinforcing forms of relief may be made available. These should include restitution as the primary remedy for human rights violations, cessation and rectification of ongoing violations or conditions, satisfaction measures carefully tailored to the nature of the harm, and guarantees of non-repetition aimed at preventing foreseeable future violations, which can be applied in a compound and sequential manner. Through such reforms, it becomes possible to move beyond the dichotomous approach between international and domestic law, and between public and private law, thereby fostering a more organic and integrated normative linkage and mutual development among international human rights law, constitutional law, and civil law.
