라틴아메리카의 새로운 헌정주의와 탈식민적 전회 = Nuevo Constitucionalismo Latinoamericano and the Decolonial Turn

국문 초록 (Abstract)

야심차고 혁명적인 사회문화 패러다임으로 탄생한 유럽중심적 근대성은 사회적 규제의 축과 사회적 해방의 축에 작용하는 역동적인 긴장 관계에 기반을 두었다. 19세기 중반이 되면서 두 축 간의 변증법적 긴장이 점차 소멸되었고 제2차 세계대전 이후 해방의 활력이 규제에 흡수되었다. 그 결과, 사회로부터 정치가 분리되는 탈정치화 현상이 발생했다. 1970년대 이후 근대주의적 법 개념에 대한 비판으로 등장한 신헌정주의는 법이 본래 가지고 있던 해방의 잠재력을 회복하기 위한 비판적 헌정주의이다. 그러나 신헌정주의는 탈정치화된 일상적 삶을 재정치화하지 못하고 사법 시스템의 정치화를 초래한다. 라틴아메리카의 새로운 헌정주의(NCL)는 신헌정주의와 더불어, 신헌정주의를 넘어선다. NCL은 헌법의 개념을 제정권력을 제한하는 데 국한시키지 않고 민주주의 원리로 확장한다. 에콰도르와 볼리비아의 헌법은 NCL의 흐름 속에서 또 하나의 분기점을 형성하는 탈식민적 헌정주의로 나아간다. 이 과정에서 오래된 원주민의 정의와 다국민성이 중요한 정치적․법적 의제로 떠올랐다. 탈식민적인 헌정주의는, 헌법 내부와 외부에서, 자유주의적이고 유럽중심적인 법 문화에 반대되는 법과 정치를 이해하는 새로운 형식을 요구한다.
