The purpose of this dissertation is to interpret the chapter on civil society(Die bürgerliche Gesellschaft) in G. W. F. Hegel’s Elements of the Philosophy of Right(Grundlinien der Philosophie des Rechts, 1821) as a critique of the liberal system. In the course of this analysis, the dissertation examines the concept of freedom articulated within Hegel’s theory of civil society as it relates to classical liberalism, and explores the possibilities for overcoming the limitations inherent in that concept of freedom. To this end, the dissertation seeks to demonstrate that the civil society described by Hegel in the Philosophy of Right functions as a thought experiment concerning the form of the state envisioned by classical liberal thinkers.
Hegel acknowledges the notion of individual subjectivity proposed by classical liberals such as Thomas Hobbes, John Locke, Immanuel Kant, and Adam Smith. However, he criticizes their concept of freedom as remaining at the level of arbitrariness, since in liberal thought freedom tends to be reduced to the pursuit of private interests by atomized individuals. Such a conception of freedom inevitably leads to social fragmentation and, ultimately, to unfreedom. Although civil society as a liberal system contains these negative consequences, Hegel describes the moments through which it can be transcended.
Classical liberalism, as represented by social contract theory and modern natural law, provided the theoretical foundations for the concept of freedom as the guarantee of individual rights. While sharing the liberal orientation, Hegel identifies its limitation in neglecting the historical and social conditions of freedom. His conception of civil society as a liberal system is organized around three moments— the system of needs, the administration of justice, and public authority with the corporation— through which the shortcomings of abstract freedom can be overcome and the transition toward concrete freedom is prepared. Thus, civil society, initially conceived as a product of classical liberalism, is reinterpreted through Hegel’s critical appropriation and presented as a foundation for realizing actual freedom in modern society.
