This study aims to examine the characteristics of students` lives in school in terms of human rights and to provide the institutional conditions and inner-school systems for promoting and extending students` rights. Learning and teaching in schools are focused on preparing high ranked students for high school and college entrance examination, and most of teachers prefer to do teacher centered teaching. Students rights described above are constrained under the following Korean educational conditions: poorly prepared experimentation lessons, forced supplementary lesson and self-study, halfhearted and mechanical extra curricula activities and homeroom activities, forced mobilization in various kinds of school activities and formal self-experience learning. Accordingly, expanding students` rights requires the following legal and social welfare apparatuses. First, it need to establish the law for protection of student rights, and establishment of detailed regulations based on this law. Second, education regarding human rights students and teachers needs to be systemized. Third, it is necessary to develop Guidelines for use of teacher authority that can provide information to teachers on the appropriate use of their authority. In order to improve the state of students rights, in parallel with these social welfare apparatus, it is necessary to change the idea of students held by teachers and administrators.
