지적재조사의 측량면적과 조정면적에 따른 조정금 비교평가 = A Study on the Liquidation Cost Assessment according to the Survey Area and the Adjustment Area in Cadastral Resurvey

This study compared the liquidation money around the parcel modified by the Commission to resurvey the area, or on the same parcel owner needs to liquidation money minimize or decrease according to the area for early completion of the review, the intellectual work.
Comparison of liquidation money was analyzed by comparing the existing survey area and the adjusted area taking into account the full economic cost of the individual to the center by minimizing the agreed boundary landowner needs.

Therefore, comparisons with liquidation money surveying the area due to the area and the owner needs or modified in this study were as follows:
First, the existing area of the colon as a result the total area of 233 parcels compared to adjusted by re-surveying and surveying area 49,874.0㎡, according to the survey area boundaries are occupied by 49,643.7㎡, the adjustment area due to an agreement between the owner or resurvey 49,643.7㎡ survey area indicated by an area between the parcel and the control area are different from each other, it can be seen that the same total area as shown there is no change between the two areas.

In addition, the implications were derived on the basis of similar cases in the present study may be generated from the business to complete the improvements proposed for the early completion of the project on the basis that the problem occurred on earth is that the various district and its significance in that and hope to be utilized as a reference on a case-by-case solutions for their application or problem that may exist in various business districts.

국문 초록 (Abstract)

본 연구에서는 사업조기완료를 위한 면적증감에 따른 조정금을 최소화하는 합의경계에 입각하여 동일한 필지에서 재측량을 의뢰하거나 소유자 요구에 의한 면적이 수정된 필지를 중심으로 개인의 경제성을 최대한 고려한 조정된 면적과 기존의 측량면적과의 조정금을 비교하여 토지소유자 요구에 의한 합의경계 중심의 비용 최소화에 대해 분석하였다.
현재 지적재조사측량에서 도시지역의 현실경계에 기초한 점유경계에 대한 측량면적의 경우 도시지역의 ㎡당 높은 지가, 합의경계 유도의 어려움, 면적조정을 위한 동일필지 재측량 등의 문제점이 발생되고 있는 것으로 나타났으며, 토지소유자 요구나 합의경계 중심으로 면적을 최소화 하여 개인의 경제성을 최대한 고려한 합리적인 조정금 비용 산정을 요구하고 있는 것으로 나타났다.
따라서 본 연구에서 측량면적과 소유자 요구나 수정 등에 의한 조정면적과의 조정금 비교결과는 다음과 같이 나타났다.
첫째, 측량면적과 재측량에 의한 조정면적을 비교한 결과 전체 233필지의 기존 대장면적은 49,874.0㎡, 점유경계에 따른 측량면적은 49,643.7㎡, 소유자간 합의 또는 재측량등에 의한 조정면적이 49,643.7㎡로 나타나 측량면적과 조정면적간 일필지별 면적은 서로 다르지만 전체 면적은 동일하게 나타나 두 면적간 변화가 없는 것을 알 수 있다.
둘째, 측량면적에 따른 조정금은 100,269,800원, 조정면적에 따른 조정금은 54,571,700원으로 나타나 기존 측량면적에 의한 조정금에 비해 45,698,100원이 보다 더 적게 산정되어 45.6%에 해당하는 조정금이 절약되는 것을 확인할 수 있었다.
셋째, 조정금 대상필지는 전체 233필지 중 109필지였으며, 이 중 500만원 미만 필지는 80필지, 500만원 이상 1000만원 미만의 필지는 16필지, 1000만원 이상 필지는 13필지로 나타났다.
넷째, 측량면적과 조정면적에 대한 조정금이 가장 많은 필지는 1088-2번지 ‘도로’로서 40,386,400원으로 나타났고, ‘대’지목 중에서 측량면적과 조정면적에 대한 조정금이 가장 많은 필지는 1066-7번지 21,571,200원, 1029-1번지 18,832,000원, 그리고 1067-4번지 17,344,600원의 순서로 나타났다.
그래서 이러한 조정금 비교를 토대로 볼 때 소유자 중심의 이웃하고 있는 토지소유자간 합의하거나 또는 토지소유자가 요구하거나 원하는 방향으로의 조정금의 산정은 결국 동일 필지를 재측량하는 시간적인 소비는 기본방법 보다 증가하겠지만 전체적인 공정으로 볼 때 면적증감 비용 최소화와 소유자 요구에 의한 합리적 비용조정 결과로 이어질 수 있어 기존의 조정금 정산과정에서 장기간 소요되었던 소요기간을 단축시킬 수 있고, 소유자가 원하는 방법에 따른 의사결정이기 때문에 정산참여에 더 적극적으로 참여할 수 있는 방법으로 나타났다.
끝으로 본 연구에서는 사업의 핵심추진단계에서 발생되는 측량면적과 조정면적에 따른 조정금의 비교분석을 제시하였으나 향후 다양한 사례지구별로 보다 더 심도 있는 업무추진 단계별로 다양한 사례분석으로 장기적인 국가사업이 조기에 완료될 수 있기를 기대한다.
또한 본 연구가 사업완료 지구에서 발생된 문제점을 토대로 사업의 조기완료를 위한 개선방안을 제시하였다는 점과 다양한 지구에서 발생될 수 있는 유사한 사례를 근거로 시사점을 도출하였다는 점에서 그 의의가 있으며, 다양한 사업지구에서 나타날 수 있는 이의신청이나 문제점에 대한 사례별 해결방안에 대한 참고자료로서 활용되기를 바란다.
