Analysis of the EU Anti-Dumping Regulations: the Korean Side-by-Side Refrigerator Case

We analyze the EU anti-dumping regulations by examining the anti-dumping case concerning Korean side-by-side refrigerators with a view to providing useful guidance for Korean exporters and Korean trade policy-makers. First, we review development of the EU anti-dumping regulations and their practices. Then we analyze the Commission's preliminary and final determinations on the Korean refrigerators. We also compare certain provisions of the EU anti-dumping rules with the WTO Anti-Dumping Agreement. They are the criteria on the sales in the ordinary course of trade, the Community interest rule (or public interest) and the lesser duty rule.

국문 초록 (Abstract)

본 논문은 2006년에 유럽집행위원회가 내린 한국산 양문형 냉장고에 대한 반덤핑판정을 기초로 하여, 세계에서 세 번째로 많이 반덤핑조치를 취하고 있는 EU가 어떻게 자국 반덤핑규정을 실제로 적용하는지를 분석한다. 먼저 EU 반덤핑규정의 발전과정 및 반덤핑조치 현황을 살펴본 뒤에 냉장고관련 예비판정과 최종판정을 분석한다. 그리고 동 반덤핑판정에 적용된 주요 규정을 WTO 반덤핑협정과 비교분석한다. EU 반덤핑규정의 일부 조항은 WTO 반덤핑협정에 규정되어 있지 않은 반면에 일부 조항은 두 규정에 포함되어 있으나 상이한 내용을 보이고 있다. ‘통상적인 거래에 있는 판매여부 판정기준’과 ‘공익규정’은 전자에 해당하고 ‘최소부과원칙규정’은 후자에 속한다.
