    전 지구적 기후변화 대응과 탄소중립 달성을 위한 국제사회의 노력이 강화됨에 따라, 에너지효율 규제는 탄소중립의 핵심적인 정책 수단으로 인식되고 있다. 화석연료 의존도가 높은 중동지역은 포스트 오일 시대를 대비한 국가 발전 전략의 일환으로 에너지효율 규제를 급격히 강화하고 있다. 이는 단순한 환경 정책을 넘어 산업 구조 전환과 에너지 안보 확보, 비석유 부문 경제 다각화를 함께 추구하는 복합적 국가 전략의 성격을 띤다. 중동지역의 중심 국가인 사우디는 Vision 2030을 중심으로 최소 에너지 성능 기준, 에너지효율 라벨링 제도, 적합성 평가 체계 등 다양한 규제를 단계적으로 도입하고 있으며, 걸프협력회의(Gulf Cooperation Council) 차원의 통합 규제도 추진하고 있다. 이러한 규제 강화 추세는 향후 더욱 가속화될 전망이어서, 중동 시장에 진출하려는 수출 기업들에 지속적인 대응 부담을 가중시키고 있다.

    본 연구는 사우디를 중심으로 한 중동 주요국의 에너지효율 규제를 무역기술장벽 관점에서 분석하고, 규제로 인한 리스크를 체계적으로 평가하여 정부와 기업 차원의 실무적 대응방안을 도출하는 데 목적이 있다. 연구 방법으로는 정성적, 정량적 방법을 결합한 혼합 연구 방법론을 적용하였다. 우선 문헌 분석을 통해 에너지효율 규제 관련 리스크 요인을 도출하여 대분류 3개(정책·제도적 리스크, 행정·절차적 리스크, 기술·경제적 리스크)와 소분류 9개로 구성된 리스크 계층구조를 설정하였다. 다음으로 계층화 분석(Analytic Hierarchy Process, 이하 AHP)을 활용하여 정부, 산업계, 인증기관 등 관련 전문가 80명을 대상으로 AHP 설문을 실시하고 각 리스크 요인의 상대적 중요도를 정량적으로 평가하였다. 마지막으로 중동 규제 분야 15년 이상의 실무 경력자 10명을 대상으로 전문가 심층면담을 실시하여 AHP 분석 결과를 검증하고 보완하였다.
    분석을 통해 정책·제도적 리스크가 가장 높은 가중치(0.4429)를 차지하는 것으로 나타났으며, 그 다음이 행정·절차적 리스크(0.3021), 기술·경제적 리스크(0.2550)순으로 평가되었다. 세부적으로 규제 불확실성 리스크(전체 1순위)와 보호무역주의 리스크(전체 2순위)가 최상위 우선순위를 차지함으로써, 중동지역 수출 리스크의 본질이 제품 기술 역량의 문제가 아닌 거시적 정책 환경의 불확실성이 있음을 명확히 보여준다. 즉, 기업이 우수한 기술력과 제품 경쟁력을 갖추더라도 규제 환경의 변동성 앞에서는 시장 진출의 안정성을 담보하기 어렵다는 의미이다. 이는 개별 기업 차원의 대응만으로는 한계가 있음을 시사하며, 정부 차원의 선제적 규제 모니터링과 양자 간 협의 채널 구축이 시급함을 뒷받침한다.
    전문가 심층면담을 통해 도출된 실무적 대응방안으로 정부 차원에서는 규제 동향 모니터링 강화, 세계무역기구 무역기술장벽(World Trade Organization Technical Barriers to Trade)협정 활용 확대, 국제 협력 강화, 기술 지원 확충이 필요하다. 기업 차원에서는 선제적 기술 개발, 규제 정보 수집·분석 역량 강화, 인증 프로세스 최적화, 맞춤형 중동 시장 전략 수립이 요구된다. 업계 협회 및 학계 차원에서는 정보 공유 체계 구축, 관련 연구 지원, 전문 인력 양성 등이 병행되어야 함을 확인하였다.

    As global efforts to address climate change and achieve carbon neutrality intensify, energy efficiency regulation has come to be recognized as a key policy instrument for carbon neutrality. The Middle East, with its high dependence on fossil fuels, is rapidly strengthening energy efficiency regulations as part of its national development strategies in preparation for the post-oil era. These measures go beyond simple environmental policy, embodying a complex national strategy that simultaneously pursues industrial restructuring, energy security, and economic diversification into non-oil sectors. Centered on Saudi Arabia's Vision 2030, various regulations—including Minimum Energy Performance Standards (MEPS), energy efficiency labeling schemes, and conformity assessment systems—are being introduced in phases, while integrated regulation is also being pursued at the level of the Gulf Cooperation Council (GCC). This trend toward tighter regulation is expected to accelerate, imposing a continuous compliance burden on firms seeking to enter Middle Eastern markets.
    Owing to divergent certification procedures across countries, the abrupt raising of standards, and opaque market surveillance systems, exporters face serious trade risks. These risks extend beyond mere technical challenges, manifesting in a compound manner across the policy-institutional, administrative-procedural, and technical-economic dimensions, and constitute a substantial barrier to market entry. For small and medium-sized exporters in particular, limited access to regulatory information and insufficient response capacity and resources can render such risks a decisive factor leading firms to abandon market entry altogether.
    This study analyzes the energy efficiency regulations of major Middle Eastern countries, with a focus on Saudi Arabia, from the perspective of technical barriers to trade (TBT); it systematically assesses the resulting regulatory risks and derives practical countermeasures at both the governmental and corporate levels. Methodologically, a mixed-methods approach combining qualitative and quantitative techniques was applied. First, through a literature review, risk factors related to energy efficiency regulation were identified, and a hierarchical risk structure was established, consisting of three major categories (policy-institutional risk, administrative-procedural risk, and technical-economic risk) and nine sub-categories. Next, using the Analytic Hierarchy Process (AHP), a survey was conducted with 80 experts from government, industry, and certification bodies to quantitatively evaluate the relative importance of each risk factor. Finally, in-depth interviews were conducted with 10 practitioners, each with more than 15 years of experience in Middle Eastern regulation, in order to validate and supplement the AHP results.
    The analysis revealed that policy-institutional risk carried the highest weight(0.4429), followed by administrative-procedural risk(0.3021) and technical-economic risk(0.2550). More specifically, regulatory uncertainty risk(ranked first overall) and protectionism risk(ranked second overall) occupied the top priorities, clearly demonstrating that the essence of export risk in the Middle East lies not in product technology capabilities but in the uncertainty of the macro-level policy environment. In other words, even firms with superior technological capabilities and product competitiveness find it difficult to secure stable market entry in the face of regulatory volatility. This suggests that responses at the level of individual firms alone are limited, and it underscores the urgent need for government-led preemptive regulatory monitoring and the establishment of bilateral consultation channels.
    As practical countermeasures derived from the expert interviews, at the governmental level there is a need to strengthen the monitoring of regulatory trends, expand the use of the World Trade Organization Agreement on Technical Barriers to Trade(WTO TBT), reinforce international cooperation, and enhance technical assistance. At the corporate level, proactive technology development, strengthened capacity for collecting and analyzing regulatory information, optimization of certification processes, and the formulation of tailored Middle East market strategies are required. At the level of industry associations and academia, the establishment of information-sharing systems, support for relevant research, and the cultivation of specialized personnel should proceed in parallel.
    The study establishes that a systematic and integrated response to energy efficiency regulatory risk in the Middle East is an essential condition for the successful market entry of exporters. Accordingly, it concludes that regulatory risk can be systematically managed by building a multi-layered cooperative system—encompassing the government's provision of regulatory information and pursuit of international negotiations, firms' proactive technology development, and the strengthening of public institutions' information-sharing functions. Furthermore, only when an organic governance framework among government, industry, associations, and academia is established will an effective response to regulatory risk become possible. These findings are expected to offer practical implications for formulating market entry strategies and shaping related policies for emerging markets where energy efficiency regulation is being strengthened.
