지적재조사를 위한 불부합지정리사업의 유형과 제도개선 연구 = Study on the types of Cadastral mismatch arrangement projects and the system improvement for the renovation of Cadastre

국문 초록 (Abstract)

지적불부합지로 인해 토지 공시제도는 대국민 관계에 있어서 불신을 초래하고 있고, 이로 인해 토지와 관련된 각종 국가행정상의 어려움도 심화되고 있는 실정이므로 지적불부합지의 해결을 위해 지적재조사(Renovation of Cadastre)사업의 필요성이 꾸준히 제기되고 있다. 이 연구에서는 지적재조사사업 내용 중에서 기장 시급하게 다루어져야하는 지적불부합지의 실제 정리사례와 사업유형별 장.단점을 살펴보았다. 연구 결과 주민합의에 의한 방법과 환지에 의한 방법에서 공통적으로 청산금의 문제와 보상절차의 지연이 발생하였고 토지개발사업을 준용하는 방법의 경우 지적공부의 정확도를 높일 수 있으나 사업비용의 전가문제 등이 발생하였음을 확인하였다. 이 연구를 통하여 향후 제정이 추진되고 있는 「지적공부의 관리와 지적불부합지의 정리에 관한 법률 제정안」에서 반드시 강화되고 보완할 사항을 살피고 실제 사업시행 시 발생할 문제점을 미리 예상해 보고자 하였다.

다국어 초록 (Multilingual Abstract)

A need to renovate cadastre has been steadily suggested as present Land Posting System has not only caused distrust to the citizens but increased many nation-wide administrational difficulties due to cadastral mismatch. In the study, cases of cadastral mismatch which should be dealt with most urgently in the cadastral renovation project and advantages and disadvantages of various cadastral arrangement projects are examined. The result of the study shows that cadastral arrangement projects by both residents' consensus and replottingled to the problems of compensation delay and settlement issues. Also, in case of implementing land development plan, the accuracy of cadastre can be higher but a problem of cost-transfer occurred. In the study, content that should be fostered or complemented in the "law for managing cadastre and an arranging cadastral mismatch", which is expected to be enacted henceforth, is suggested and potential problems in implementing actual arrangement projects are considered.
