민주주의와 전자투표에 관한 법적고찰 -미디어법을 통해 바라본 전자민주주의- = Legal study on democracy and electronic voting -Electronic democracy in the aspect of media law

다국어 초록 (Multilingual Abstract)

Since last year, adverse criticism related to media law revision has be continued up tp the present. Although content on revised bill itself was criticised, the problem on its procedure is emerged as well. it vote was performed by electronic voting, in which proxy vote was important criticized. Because one vote per a person became two votes per a person, which lost effectiveness on the whole decision by serious legal procedure violation. Like this, as going through media law revision procedure, the problem on legal decision-making procedure and the electronic voting according to parliament vote was proposed by each social layer. Especially, matters on electronic vote among them has been hot potato under the condition that the opinion, in which even national referendum should be based on the electronic voting, is proposed. Therefore, this study examines constitutional consideration on whether the electronic voting is actually agreed with democracy. In spite of various problems, it is very hard to give up the electronic democracy even for the national assembly's realizing real representative democracy on the half of the people's opinion forming public settlement as well as for playing role as a bumper on social demand. The problem is to first raise the awareness of people to perform the electronic voting and also, if the system to compensate for the problem is improved, the electronic voting can show the right way to advance toward representative democracy.
