국제규범의 집행에서의 협력적 관계의 중요성

국문 초록 (Abstract)

한 나라가 국제적 인권규범을 도입하면, 일국내의 국민들은 그러한 규범에 근거하여 인권과 관련하여 문제제기를 할 근거를 갖게 된다. 그러나 규범의 도입이 그 규범의 실제적 이행을 보장하는 것은 아니다. 모든 국제규범의 실제적 이행은 국제적, 국내적 담당 주체가 해당 규범의 이행을 위해 자신의 역할을 제대로 할 때 비로소 가능해 지게 되는 것이다. 한 나라에서 국제규범이 일국 내의 규범으로 국내화하기 위해서는 일종의 여과(filtering)와 융합 (fusion)의 과정을 거치게 된다. 따라서 실제적인 변화를 이루기 위해서는 국내적 요소와 국제적 요소가 어떤 역할을 하는지에 대해 구체적이고도 면밀한 고려가 필요하고, 실제로 작동 가능한 변화의 주체를 형성하는데 가장 적합한 방법이 무엇인지를 현실 속에서 찾지 않으면 안 된다. 이러한 관점에 근거하여 이 글에서는 지속적인 협력적 네트워크의 존재 여부가 국제규범의 이행과 인권의 개선에 결정적으로 중요하다는 점을 강조하고, 그와 같은 협력 관계를 모색해 감에 있어서 특히 중요하게 고려되어야 할 원칙들에 대해 검토한다.

다국어 초록 (Multilingual Abstract)

The adoption of human rights norms in a country is a big step toward enforcement allowing the people to use them to strengthen the position of human rights movements. However, the adoption of norms does not guarantee the implementation. If the norms are not supported by domestic and international actors, the protection of human rights will not be achieved. International norms go through the filtering and fusion process to be domesticated, and the interactions among the actors make the actual changes possible. A proper understanding of the roles of the actors are crucial. It is especially important to acknowledge the cooperative aspects of human rights in the process. Criticism can and should be combined with cooperation. One-dimensional, confrontational approach does not guarantee the successful implementation. A well-balanced, comprehensive strategy with a contextual understanding of a society will enhance the implementation of human rights.
