    본 논문은 이탈리아가 유럽 연합(EU)의 문화유산 디지털 전환 규범을 수용하고 기존의 제도를 재구성하는 과정을 다루고 있다. 이를 위해서 유럽 연합의 규범과 법령들을 이탈리아의 법령, 정책, 지침과 상호 비교하여 법과 정책을 살펴보았다. 디지털 전환은 디지털화, 온라인 공개, 플랫폼의 구축뿐만 아니라, 문화유산 데이터의 생산, 유통, 재사용 조간을 규정하는 규칙과 제도, 행위자의 위임과 참여를 다룬다는 점에서 거버넌스의 문제로 논의할 필요가 있다. 유럽 연합에서는 공공 부문 데이터 재사용 지침과 오픈 데이터 규범이 공공 부문 정보의 재사용을 기본 원칙으로 다뤄왔으며, 디지털 단일 시장 저작권 지침 제 14조는 퍼블릭 도메인에 해당하는 작품들의 복제물에 대한 독점을 억제하고 있다. 또한 일반 개인정보 보호 규정과 공공 부문 웹 접근성 지침은 디지털 공공 서비스에 권리 기반의 제약과 책무성 요구를 내재화했다. 이 같은 환경의 변화 속에서 이탈리아는 입법령 36/2006 및 입법령 200/2021 등 국내법 이행과 이탈리아 디지털청(AgID)의 기술 지침을 통해 표준화, 상호운용성, 집계 체계를 강화하였다. 동시에 국가 복원 및 회복 계획(PNRR)의 재원에 기반을 둔 정책 프레임워크, 디지털 라이브러리, 국가 디지털화 계획(PND, 2022–2026) 등 문화유산 디지털 인프라를 구축함으로써 문화유산 디지털화를 유로피아나(Europeana)와 연계되어 있는 국가 조정형 데이터 생태계로 전환하고 있다. 또한 쿨투라이탈리아(CulturaItalia)를 통해 데이터의 집계와 유로피아나에 제공함으로써 유럽 연합과 연계한다. 그러나 동시에 이탈리아는 문화재 및 경관법 제108조와 장관령 161/2023, 장관령 108/2024에 근거한 허가 및 요금 중심의 행정 구조를 유지함으로써, 유럽 연합이 지향하는 재사용 촉진 및 디지털 공공영역 보호의 논리와 행정적 통제, 수익 정당화 논리 간의 구조적 긴장감도 관찰할 수 있다. 본 연구는 이 같은 상호 작용을 추적함으로써 문화유산의 디지털 전환의 성패가 기술 자체가 아니라 재사용 조건과 책무성 메커니즘의 설계에 달려 있다는 사실을 보여준다.

    This article examines how Italy has adopted and reconfigured the European Union’s normative framework for the digital transformation of cultural heritage. Rather than treating digital transformation as a matter of digitization, online access, or platform building alone, the study conceptualizes it as a governance problem concerning the rules and institutions that shape the production, circulation, and re-use of cultural-heritage data. At the EU level, the PSI/Open Data acquis establishes re-use as the default principle for public-sector information; Article 14 of the DSM Directive seeks to prevent the re-appropriation of faithful reproductions of public-domain works; and the GDPR and the Web Accessibility Directive embed rights-based constraints and accountability requirements into digital public services.
    Against this backdrop, Italy has transposed EU rules into domestic legislation (notably Legislative Decrees No. 36/2006 and No. 200/2021) and operationalised them through technical guidelines issued by the Agency for Digital Italy (AgID), strengthening standardisation, interoperability, and aggregation.
    In parallel, the PNRR-funded policy architecture — centred on the Digital Library, the National Digitisation Plan (PND, 2022–2026), and the I.PaC infrastructure — recasts cultural-heritage digitisation as a coordinated national data ecosystem linked to Europeana via CulturaItalia. However, Italy simultaneously maintains an administrative regime governing the use of images of state-held cultural heritage through permits and fees under Article 108 of the Cultural Heritage and Landscape Code and subsequent ministerial decrees (D.M. 161/2023; D.M. 108/2024). The article argues that this dual arrangement institutionalizes a structural tension between EU principles of enabling re-use and safeguarding the digital public domain, and Italy’s administrative control and revenue-justification rationales. By tracing this interaction, the study shows that cultural-heritage digital transformation hinges on the design of re-use conditions and accountability mechanisms rather than on technology alone.
