국문 초록 (Abstract)

ISBP 745는 UCP 600을 개정하거나 새로운 관행을 만드는 것이 아니라 기존 관행의 구체적인 의미 해석 및 실무 적용을 어떻게 할 것인지를 결정하는 해설서이다.
현재 각 국가들의 법률 등은 ISBP 745에서 규정하는 것, 또한 다른 관행들도 동시에 규정하고도 있으므로 신용장과 관련되었을 때 자국 국내법과 상충되지 않는다면 UCP 600, ICC Opinion, ISBP 745 등을 반영하고 있다.
ISBP 745의 광범위한 사용은 신용장의 작성 및 서류심사의 국제적 통일성을 높일 수 있고, 제시된 서류의 하자발생 비율을 줄일 수 있다.
ISBP 745는 Opinion(의견), Decision(결정), Position Papers(위치서류) 등을 적용 가능한 범위 내에서 반영하고 있고, 서류심사를 할 때 Opinion 등을 일일이 찾아보지 않고 ISBP 745만 찾아보아도 대부분의 의문점이 해소될 수 있다. 이에 따라서 본 논문은 ISBP 745의 실무적 적용범위와 서류적용의 고려사항 등에 관해 검토하고자 한다.

ISBP 745(International Standard Banking Practice) is a manual which interprets specific meanings of existing customs relating to UCP 600 and deals with their practical applications.
As the laws of each country regulate what is included in ISBP 745 and other norms simultaneously, if a Letter of Credit does not contradict each country s domestic law then UCP 600, ICC Opinion, and ISBP 745 reflect this. Extensive use of ISBP 745 can increase international uniformity in Letter of Credit forms and document inspection, and decrease error rates in documents submitted.
ISBP 745 reflects opinions, decisions, and position papers within the range applicable, and most questions can be answered using ISBP 745 during document inspection, without the trouble of searching for other opinions. Therefore, this study aims to examine the practical coverage of ISBP 745 and considerations in document applications.
