    사회복지시설 종사자의 인권침해 실태와 개선 방안: 이용자 및 운영자의 폭력을 중심으로

    본 연구는 사회복지시설 종사자들의 인권침해 실태를 파악하고, 이를 개선하기 위한 목적으로 수행하였다. 사회복지시설 종사자 20명이 심층 면접에 참여하였다. 본 연구의 주요 결과는 다음과 같다. 심층 면접 참여자 20명중 9명(45.0%)이 인권침해를 당한 경험이 있었다. 가해자는 시설 이용인(33.0%), 시설 운영자(33.0%), 시설 이용인의 보호자(25.0%), 동료 종사자(9.0%) 등이었다. 침해 유형은 인격 무시, 부당한 업무 지시, 출퇴근 시간 미보장, 욕설, 휴식 시간 미보장, 원하지 않는 신체 접촉, 폭행, 성희롱, 성추행 등이었다. 사회복지시설 종사자들은 인권침해를 경험하더라도 침묵하거나 감내하는 방식으로 대응하는 태도를 보였다. 이러한 태도의 배경은 가해자에게 시정을 요구하더라도 상황이 개선될 가능성이 낮다고 인식하거나, 자신에게 불이익이 돌아올 것이란 두려움 때문인 것으로 나타났다. 연구 결과를 바탕으로 제시한 개선 방안은 다음과 같다. 사회복지시설 종사자에 대한 사회적 인식을 개선하고, 사회복지사 등의 처우 및 지위 향상을 위한 법률을 개정해야 한다. 시설 자체 대응방침을 마련하고, 처우에 있어서 지역간·시설간 차별을 해소해야 한다. 사회복지시설 이용인과 보호자도 인권교육 대상에 포함시켜야 하며, 시설 이용인과 종사자의 인권보호를 같은 비중으로 교육시켜야 한다.

    This study was conducted for the purpose of identifying and improving the human rights violations of social welfare facility workers. Twenty workers of social welfare facilities participated in in-depth interviews. The main results of this study are as follows. Nine out of 20 participants (45.0%) had experienced human rights violations. The perpetrators were facility users (33.0%), facility operators (33.0%), guardians of facility users (25.0%), and fellow workers (9.0%). The types of infringement were neglect of personality, unfair work instructions, non-guaranteed commuting time, abusive language, non-guaranteed break time, unwanted physical contact, assault, sexual harassment, and sexual harassment. Workers in social welfare facilities responded in a silent or tolerable way even if they experienced human rights violations. The background of this attitude was found to be due to the perception that the situation was unlikely to improve even if the perpetrator was asked to correct it, or the fear that disadvantages would return to them. The improvement measures suggested based on the research results are as follows. The law should be revised to improve social awareness of social welfare facility workers and to improve the treatment and status of social workers. The facility's own response policy should be prepared, and discrimination between regions and facilities should be resolved in treatment. Users and guardians of social welfare facilities should also be included in the subject of human rights education, and the protection of human rights of facility users and workers should be educated in the same proportion.
