    이 글은 국가 수준의 정치공동체 개념과 시민권 개념을 분해하여 비국민인 외국인의 지방 선거권이 국가 시민권(national citizenship)의 지위에서 가능한 것이 아니라, 지방 정치공동체 소속원의 지위에서 나오는 것임을 밝혀보았다. 정치공동체와 시민권 개념을 모두 세분해서 보는 인식 틀에서는 외국인에게 지방 선거권을 부여하는 정책이 상대적으로 쉽게 허용될 수 있는 반면, 정치공동체와 시민권을 민족국가의 틀 안에서 단일한 것으로 보는 인식 틀에서는 외국인에게 지방 선거권을 부여하는 정책이 쉽게 산출될 수 없음을 한국과 일본의 사례를 통해서 확인하였다. 한국에서는‘지방 정치공동체와 지방 시민권’을‘국가 정치공동체와 국가 시민권’과 구분하여 보는 인식이 지배적인 인식 틀로 받아들여졌고, 이 문제를 둘러싼 뚜렷한 정치적 균열구도가 없는 상태에서 비교적 쉽게 영주권자에게 지방 선거권이 부여되었다. 반면 일본은 지방 정치공동체와 국가 정치공동체를 동일하게 보고 국민과 주민을 하나로 보는 인식이 지배적인 인식 틀로 구축되어, 대항적인 인식 틀과 팽팽하게 대립하며 정책 논쟁이 전개되고, 이 문제를 중심으로 정당간 균열구도가 첨예하여, 현재까지 영주권자에게

    Since Korea and Japan agreed to grant resident aliens local voting rights, Korea passed the law in 2005 and Japan failed to pass the law. Assuming that national political community can be differentiated into multi-layered local political communities, this paper asserts that one of the main reasons of the dissimilar policy outputs in Korea and Japan is the different perception on the relations between the national and local political communities, and between‘ people’and‘ residents.’ In the public and parliamentary debates on the issue, the dominant perception of Korea is that local community is an independent political space from national political community and thus, all residents including aliens and nationals are equally eligible for members of local community where they reside. Therefore, the resident aliens have the rights to participate into local policy making process. In contrast, Japan undergoes inter and intra party conflicts on this issue. The dominant perception of Japan is that local political community is a subordinate part of national one and thus at a single political community in a territorialized state, only the nationals are eligible for members of local community. Accordingly, the resident aliens cannot have local voting rights as long as they are not naturalized in Japan.
