1926년에 제정된 인도 노동조합법의 노동조합 설립 및 승인에 관한 규정은 ① 노동조합의 강제적 승인 조항의 결여, ② 노동조합 조합원자격 확인제도의 미비, ③ 외부 정치지도자의 노조 참여 인정, ④ 노조 등록 신청에 대한 처리 시한 조항의 결여 등의 주요한 결함이 있음에도 불구하고, 인도정부는 이를 80년 이상이나 그대로 방치함으로써 취약하고 파편화된 노동운동을 영구화하였다. 아울러 1947년의 인도 노동쟁의법 하에서 노동부장관이나 주 총리가 행사하는 거의 무제한의 노동쟁의 해결 권한은 이들에게 줄이 닿는 외부 정치인에게 노동운동이 계속 의존하지 않을 수 없게 하고 있다. 이는 인도 노동조합뿐만 아니라 인도 산업 전체를 훼손시키고 있다. 파업과 직장폐쇄가 빈발하고, 이것들은 거의 항상 불법적이다. 때로는 폭력과 유혈사태가 발생하기도 한다.
인도정부는 주요 서비스산업뿐만 아니라 여러 공공산업분야의 사용자로서 노동조합주의를 인정하고, 지금까지 비준을 미루고 있는 국제노동기구(ILO)의 1948년의 ‘결사의 자유 및 단결권의 보호에 관한 협약’과 1949년의 ‘단결권 및 단체교섭권에 대한 원칙의 적용에 관한 협약’에 즉각 비준해야 한다. 인도정부는 이 협약들에 규정되어 있는 모든 노동복지 법률들을 이행하기 위한 최우선 과제로 인도 노동조합법에 다음 사항들을 즉시 도입해야 한다. ① 외부인이 노동조합의 집행부 또는 임원으로 되는 것을 허용하지 않음으로서 정치결탁으로부터 노동조합을 독립시킬 것, ② 조합원이 전체산업종사자, 즉 종업원의 15% 이하인 노동조합은 등록할 수 없도록 할 것 ③ 사용자에 의한 강제적 노조 승인 조항을 둘 것, ④ 노동조합 등록 한계시한에 관한 조항을 둘 것, ⑤ 노조와 부당노동행위 및 노동쟁의의 해결을 위한 통합된 법률을 제정할 것 등이다.

The Trade Unions Act, 1926 has some shortcomings in the provisions of formation and recognition of trade unions. They are (a) no provisions for statutory union recognition; (b) lack of the method for ascertaining union membership; (c) to allow the trade union to enroll outsiders as members; (d) no prescription of the time limit within which the Registrar of Trade Unions is to grant or deny registration, etc. The Government of India has, however, not exerted itself to correct these shortcomings for more than 80 years and has perpetuated a weak and divided labour movement. And moreover, as long as the Industrial Disputes Act, 1947 gives to Labour Ministers or Chief Ministers the plenary power to settle industrial disputes, workers will continue to be dependent on outside politicians who have contacts at these Ministers. All this has seriously vitiated not only the trade unions but the industrial scene in India as a whole. Strikes and lock-outs are rampant, although they are almost always illegal. Occasionally there is violence and bloodshed.
The Government of India, as the owner of various public sector industries as well as major service industries, is to accept the trade unionism and immediately ratify the ILO Convention on Freedom of Association and Protection of the Right to Organize, 1948 and the ILO Convention on the Right to Organize and Collective Bargaining, 1949. For the first and foremost step to implement all the labour welfare laws as laid down in the ILO Conventions, it has to introduce at once the following changes in the Trade Unions Act: (a) de-linking trade unions from the clutches of politicians by not allowing outsiders to be members of the executive or office bearer of any registered trade union; (b) not to register workers trade unions having less than 15% of the total number of workers of the industry as its members; (c) to make provisions for compulsory recognition of trade unions by the employers; (d) to make provisions for time bound registration of trade unions; (e) to have a consolidated law which would deal with not only trade unions but also unfair labour practices and machinery of settlement of industrial disputes.
