항만재개발사업 추진 체계 재정립 연구 - 항만재개발사업 업무 매뉴얼 개선을 중심으로

국문 초록 (Abstract)

1. 연구 배경과 목적
1) 연구 배경
■ 항만재개발사업 추진 과정에서 복합적인 애로사항 존재 및 기존 『항만재개발사업의 업무 매뉴얼』(이하 ‘기존 업무 매뉴얼’)의 활용도 저하
- 항만재개발사업은 2007년 법 제정 이후 본격 추진되었으나, 역사가 상대적으로 짧으며 제도적 변화가 많아 사업 추진 과정에서 애로사항 발생
- 현재까지 완료된 항만재개발사업은 3건에 불과하고, 개별 사업별 추진 방식과 참여 주체가 상이하여 사업 시작부터 준공까지 일관된 업무 추진 경험 및 문제 해결 사례의 체계적 축적 미흡
- 2021년 제작된 기존 업무 매뉴얼은 사업단계별 절차 해설 중심으로 구성되어 있으며, 최근 법령 개정 내용 미반영 및 다양한 오류 포함
- 특히 수용·사용방식, 환지방식 등 기존에 활용되지 않은 사업 추진 방식 등에 대한 절차와 설명이 부족하여 정책 담당자들의 활용도가 낮음
2) 연구 목적
■ 본 연구의 목적은 항만재개발사업의 추진 체계를 재정립하고 제도적 변화 등을 충실히 반영한 「항만재개발사업의 업무 매뉴얼(안)」(이하 ‘업무 매뉴얼(안)’)을 제시하는 것이며, 아래의 세부 연구목적을 포함
- 첫째, 수용·사용방식, 환지방식 등 사업 시행방식에 대한 절차, 문제점, 대응 방안을 검토·분석하여 개선된 업무 매뉴얼(안)에 반영
- 둘째, 항만재개발사업의 단계별 사업 절차 분석을 통해 보다 정교한 사업 추진 절차 및 주체별 역할을 제시
- 셋째, 기존 업무 매뉴얼의 내용 중 현행 법령과 상이하거나 개정된 법령 사항 등을 보완
- 넷째, 타 개발사업 업무 매뉴얼 분석을 통해 Q&A, 판례 해설 등 업무 매뉴얼 활용도 및 이해도 제고 방안 모색 및 적용
- 다섯째, 개선된 업무 매뉴얼(안)의 정책 담당자 및 이해관계자 활용도 제고 방안 모색

■ 「제3차 항만재개발 기본계획」을 통해 19개 사업 예정지를 지정하였으며, 현재 4개 사업 조성 중
- 현재까지 착공된 사업들은 모두 총사업비 정산방식으로 시행되었으며, 사업계획 수립 중인 인천항 내항 1·8부두 및 부산항 북항 2단계사업은 수용·사용방식으로 추진 계획
■ 「항만재개발법」 제정 이후 이루어진 주요 법령의 개정 내용 반영 필요
- 특히 2025년 5월부터 적용된 관리청 이원화는 향후 지방관리항의 재개발사업에 중요한 변수가 될 수 있어 절차 및 세부 업무규정 명확화 필요
■ 항만재개발사업 추진에 있어 다양한 애로 요인들이 상존하며, 지속적인 후속연구 및 기관 간 협의가 필요
- 항만재개발사업의 주요 애로 요인으로는 공공성·사업성의 균형 확보 어려움, 총사업비 정산 제도의 법·제도적 미비, 행정주체 불명확으로 인한 기반시설 이관 및 사후관리 애로 등이 있음
- 업무 매뉴얼만으로 근원적 애로 요인 해결에는 한계가 있으나, 개선된 업무 매뉴얼(안)을 통해 정책 담당자 및 이해관계자 업무 지원 가능
■ 항만재개발사업의 사업 단계별 절차 및 주체 역할, 유의사항을 점검하고, 다양한 사업 시행방식별 특징 및 주요 쟁점을 비교 분석
- 총사업비 정산방식은 적용 근거 미비로 정산 범위, 산정 방식, 토지 귀속 범위 등에 관한 구체적 규정 마련 필요
- 수용·사용방식 및 환지방식은 「항만재개발법」에 적용 근거는 존재하나, 요건·절차의 세부사항이 여러 법령에 분산되어 있고 구체적 실행 기준이 미비하여 원활한 사업 추진 담보 곤란 및 실무 혼선 우려
- 업무 매뉴얼(안)에서는 관련 법령 간 관계 및 절차별 검토사항을 구체적으로 제시하여 사업 이해관계자가 사업 추진 과정에서 수행해야 할 업무 범위와 주요 쟁점을 명확히 파악할 수 있도록 지원 필요

- 일부 매뉴얼은 관련 법령의 간략 개요·조문만 제시하고 있으나, 기존 『항만재개발사업의 업무 매뉴얼』의 경우 전체 조항을 나열식으로 수록하여 불필요한 분량 증가 및 독자의 신속한 정보 탐색 저해
- 또한 각 매뉴얼마다 비중 있게 다루는 분야를 별도 챕터로 구성하여 상세 설명하고 있으며, 대부분 절차 흐름도, Q&A, 사례·판례 등 실무 지원도구 적극 활용
■ 항만재개발사업 업무 매뉴얼의 개선 방향은 크게 다음의 3가지 측면임
- 법령 개정 반영, 사업 시행방식의 절차 및 지침 내용 보완 및 오류 수정
- 각 장에 맞는 내용 재배치 및 중복 내용 수정, 법 조문 전체 인용 지양, 절차도 개선 등 구성 개편 및 가독성 제고
- 단계별 주요 검토사항, 질의응답(Q&A), 사례, 타 사업 사례 등 실무 지원 도구 수록
■ 개선된 업무 매뉴얼(안)은 총 7장으로 구성, 단계별 절차와 다양한 사업 시행방식별 검토, 실무적 유의사항 등을 포함
- 본 보고서에서 개선된 전체 업무 매뉴얼(안) 전문은 부록으로 수록

2) 정책화 방안
■ 업무 매뉴얼의 검증 및 공식 발간·배포
- 현재 해양수산부에서 수립 중인 ‘항만재개발 기본계획 수정계획’ 등과 연계하여 본 연구에서 제시한 업무 매뉴얼(안)을 다각적 재검토 및 내용적·디자인적 보완
- 업무 매뉴얼(안)의 온라인 게재 및 유관기관·이해관계자 대상 인쇄·배포로 활용도 제고
■ 업무 매뉴얼의 정기·수시적인 업데이트
- 정책 환경 변화, 법령 개정 내용 및 추후 발견된 오류 사항의 수시적 업데이트
- 항만재개발 기본계획 수립 주기와 연계한 정기적 업데이트

- 정책 담당자 및 이해관계자 대상 오프라인 집합교육 정례화 및 온라인 교육 콘텐츠 병행
■ 관리청인 지자체 대상 별개 하위 지침 마련 지원
- 현행 「항만재개발법」 하위 지침의 사업 추진 관련 세부 규정들은 여전히 관리청이 해양수산부일 경우로만 상정하고 있는 관계로 지방관리항 관할 지자체 대상의 별도 하위 지침 수립 지원

4. 기대 효과
■ 정책 담당자와 이해관계자의 절차적 이해 제고로 관련 인허가 준비 기간 단축 및 불필요한 지연 감소 통한 사업 추진 속도 향상
- 특히 수용·사용방식, 환지방식 등 새로이 보강된 사업 추진 방식에 대한 절차 수록으로 향후 사업 실무에 기여
■ 기관 간 의견 충돌 및 이해관계자와의 갈등 감소
- 체계적인 절차, 기관별 역할 분담, 위험요인 및 갈등 소지에 대한 사전 점검을 통해 갈등을 미연에 방지
■ 정책 집행의 일관성 유지를 통한 행정 신뢰도 제고
- 특히 관리청 역할 경험이 부족한 지방자치단체의 시행착오 감소 및 사업 지연 방지로 대외적 행정 신뢰도 향상

1. Background and Purpose
1) Background
■ The implementation of port redevelopment projects is confronted with multifaceted challenges, while the practical applicability of the ‘Operational Manual for Port Redevelopment Projects’ (hereinafter referred to as ‘the existing operational manual’) has significantly diminished.
- Port redevelopment projects have been actively pursued since the enactment of the legislation in 2007. However, the relatively short history and frequent institutional changes have resulted in challenges during the project implementation process.
- To date, only three port redevelopment projects have been completed, each employing different implementation approaches and involving distinct stakeholder groups. This has resulted in insufficient systematic accumulation of consistent operational experience and problem-solving cases throughout the entire project cycle from initiation to completion.
- The existing operational manual, developed in 2021, primarily focuses on procedural explanations for each project phase. However, it fails to reflect recent legislative amendments and contains various errors.
- In particular, this manual lacks adequate procedures and explanations for previously unutilized implementation methods such as acquisition, use schemes, and land readjustment methods, resulting in low utilization among policy practitioners.

2) Purpose
■ The purpose of this study is to reestablish the implementation framework for port redevelopment projects and to present an ‘Operational Manual for Port Redevelopment Projects (draft)’ (hereinafter “Operational Manual Draft”) that comprehensively reflects institutional changes. This study encompasses the following specific research objectives:
- 1) To examine and analyze the procedures, challenges, and countermeasures for project implementation methods such as acquisition, utilization, and land readjustment methods, and to incorporate these analytical findings into the revised Operational Manual Draft
- 2) To propose more refined project implementation procedures and role specifications for each stakeholder by conducting a comprehensive phase-based analysis of port redevelopment project execution
- 3) To update the existing Operational Manual by addressing discrepancies with current legislation and incorporating amendments to relevant laws and regulations
- 4) To explore and apply measures for enhancing manual utilization and operational comprehension through the analysis of operational manuals from other development projects, including the incorporation of Q&A sections and case law interpretations.
- 5) To identify strategies for improving the practical applicability of the revised Operational Manual Draft for policy administrators and relevant stakeholders

2. Methodology
1) Academic Methodology
■ A multifaceted review of literature
- Review of prior research on domestic port redevelopment projects and policy manual development studies in other sectors
- Examination of major amendments to the Port Redevelopment Act and related legislation
- Establishment of improvement directions for the Operational Manual Draft through comparative analysis of the existing operational manual and those of similar development projects in other sectors
■ Comparative case analysis of other development projects
- As port redevelopment projects have limited accumulation of contentious issues, judicial precedents, and authoritative interpretations, this study analyzes legal interpretations, case law, and Q&As related to similar issues from other development projects and incorporates them into the Manual.

2) Policy-making Methods
■ To enhance the practicality and policy applicability of the Operational Manual Draft, periodic interviews and consultations were conducted with government policy officials and field experts throughout the research process.
- Administrative procedures for port redevelopment project implementation were verified through input from those in charge of field policy.
- Expert consultation was conducted to gather opinions on specialized knowledge in port redevelopment projects and interpretations of similar legal precedents.

3. Result
1) Summary
■ The Basic Plan for Port Redevelopment Projects designated 19 prospective project sites, of which four are currently under development.
- All projects commenced to date have employed the total project cost settlement approach, whereas the Incheon Inner Port Piers 1 and 8 and Busan North Port Phase 2 projects, presently in the planning phase, are scheduled to proceed under the acquisition and utilization method.
■ Major legislative amendments following the enactment of the Port Redevelopment Act need to be incorporated.
- Notably, the dual port authority system implemented in May 2025 could serve as a significant factor in redevelopment projects of locally managed ports, necessitating clarification ofprocedures and specific operational requirements.
■ Variouschallenges persist in the implementation of port redevelopment projects, requiring continuous follow-up research and coordination between relevant agencies.
- Key challenges include difficulties in balancing public interest with commercial viability, insufficient legal and institutional frameworks for the total project cost settlement system, and complications in infrastructure transfer and post-management due to unclear administrative authority.
- Although operational manuals alone cannot fundamentally address these challenges, the revised Operational Manual Draft can provide valuable support to policy officials and stakeholders.
■ Thestudy examines procedures, roles of implementing entities, and key considerations at each project stage, and conducts a comparative analysis of the characteristics and major issues associated with various project implementation methods.
- The total project cost settlement method lacks sufficient legal basis, necessitating specific regulations regarding settlement scope, calculation methods, and scope of land vesting.
- The acquisition and utilization method and land readjustment method have legal basis in the Port Redevelopment Act. However, detailed requirements and procedures are fragmented across various statutes with inadequate implementation standards, potentially hindering smooth project advancement and causing potential confusion in the field.
- The Operational Manual Draft should explicitly present the relationships among relevant laws and review considerations for each procedure to enable stakeholders to clearly identify their operational scope and key issues throughout the project implementation process.
■ Review of the existing operational manual identified items requiring supplementation, including provisions incompatible with current regulatory frameworks and omitted content.
■ A comparative analysis of operational manuals from seven similar development projects was conducted to derive improvement directions for the port redevelopment operational manual.
- Certain manuals were organized by detailed project phases and procedures, whereas others adopted a functional or thematic structure.
- While some manuals provided concise overviews of relevant legislation, the existing operational manual lists entire statutory provisions in an enumerative format, creating unnecessary length and hindering efficient information access.
- Most manuals included dedicated chapters for key topic areas and actively incorporated practical tools such as process maps, Q&A sections, and case examples.
■ This study established improvement directions for the operational manual in three main aspects:
- Reflection of legislative amendments, supplementation of procedures and guidelines for implementation methods, and error correction
- Structural reorganization and readability enhancement through content reallocation, elimination of redundancies, reduced reliance on full statutory quotations, and improved process diagrams
- Incorporation of practical support tools including stage-specific review items, Q&A sections, case examples, and comparative project cases"
■ The improved Operational Manual Draft comprises seven chapters covering stage-by-stage procedures, comparative reviews of implementation methods, and practical considerations.
- The complete version of improved Operational Manual Draft is provided as an appendix to this report.

2) Policy Recommendations
■ Verification and official publication and distribution of the Operational Manual
- Conduct multifaceted review and improve content and design of the Operational Manual Draft in coordination with the Ministry of Oceans and Fisheries' Revised Basic Plan for Port Redevelopment currently under development
- Enhance accessibility and utilization by publishing the Operational Manual Draft online and distributing printed copies to relevant agencies and stakeholders
■ Regular and ad hoc updates to the Operational Manual
- Update periodically to reflect changes in policy environment, legislative amendments, and subsequently identified errors
- Conduct regular updates aligned with the port redevelopment basic plan development cycle
■ Periodic training on the Operational Manual
- Establish regular offline training sessions for policy officials and stakeholders alongside online educational content
■ Support development of separate subordinate guidelines for local governments as port authorities
- Support establishment of separate subordinate guidelines for local governments with jurisdiction over locally managed ports, as current subordinate guidelines under the Port Redevelopment Act still assume the Ministry of Oceans and Fisheries as the sole port authority
4. Expected Outcomes
■ Improved project implementation speed through enhanced procedural understanding
- Contribute to future project implementation by incorporating procedures for newly improved methods including acquisition and use method and land readjustment method
■ Reduction of inter-agency conflicts and stakeholder disputes
- Proactively prevent conflicts through establishment of systematic procedures, clear institutional role distribution, and preliminary review of risk factors and potential conflict sources
■ Improved administrative credibility through maintenance of policy implementation consistency
- Boostadministrative credibility by reducing trial and error among local governments inexperienced in port authority roles and preventing project delays
