The modern construction industry is characterized by complex, multi-layered subcontracting structures involving contracts for work, services, and outsourcing. As a result, safety blind spots frequently arise due to the separation of responsibility between the principal contractor, who exercises actual control over the working environment, and subcontractors, who maintain only a formal employment relationship with workers. In particular, while the Serious Accidents Punishment Act imposes liability based on substantive control, operation, and management, the Occupational Safety and Health Act (OSHA) contains exemption provisions that exclude construction project owners from the category of contractors. This regulatory inconsistency has intensified legal uncertainty in practice.
Against this backdrop, this study analyzes the legal criteria distinguishing construction project owners from contractors and examines the legal nature of substantive employer liability, focusing on the recent Supreme Court decision in the Incheon Port Lock Gate Maintenance Project case (Supreme Court of Korea, November 14, 2024, Decision No. 2023Do14674). In this case, the Court held that when a public institution, as the project owner, normatively and substantively leads, supervises, and comprehensively manages construction activities, it qualifies not as a mere owner but as a “contractor” under the OSHA and therefore bears statutory occupational safety and health obligations. This ruling assigns liability based not on formal contractual titles or possession of construction qualifications, but on actual authority over risk control, and may be interpreted as adopting the theory of inherent (original) responsibility.
Building upon this judicial stance and theoretical analysis, this study proposes a legislative alternative in the form of a “hybrid liability model” that integrates the theory of inherent responsibility, the theory of parallel liability, and the supplementary function of vicarious liability. Specifically, the study recommends: (1) establishing the principle of inherent responsibility centered on the concept of the substantive employer; (2) introducing a parallel liability structure applicable to project owners, contractors, and managers; (3) creating presumptive provisions regarding substantive employer status to alleviate the burden of proof; and (4) adopting differentiated liability schemes based on types of risk, along with mitigation or exemption provisions where substantive safety measures have been properly implemented. Through these measures, the proposed model seeks to prevent the unlimited expansion of liability and excessive criminal punishment while enhancing the effectiveness of industrial accident prevention within complex subcontracting systems.
