지방교육자치에 대한 정책논증 - 교육위원회 운영과 교육감 직선제 개선의 정당성 - = Policy Arguments about Act on Local Educational Autonomy: A reformative orientation

This article critically examines to find the appropriate policy for local educational autonomy system. In detail, the article searches to guide the reformative orientation of the two current policies in focus of constitution of local educational board and election system of superintendent. It is argued that while changed in public service system and subject of educational administration, the authority and accountability should coincide with transformation of the related acts. As a result, the act obtains the legitimacy of power shift. However, recent examples of local educational autonomy system change deepen the conflict between the educative people and the administrative people. To solve the conflict, this article analyzes the following criteria in the perspective of policy argument method: educational perspective vs. economic perspective, education related control vs. public control, independence of educational administration, and professional management in education. The results of the policy arguments showed the followings. First, in the perspective of local autonomy system, eligibility for election of local educational board member and superintendent may be restricted within direct educational stakeholder. Second, the board member`s status may be strengthened in the focus of educational professionalism and political impartiality. Third, the superintendent`s duty should be clearly classified in the educational perspective. And the superintendent`s status about ambiguous act on local autonomy (Article 112) should be fixed in the educational professionalism. Finally, educational effectiveness should be fundamentally considered in the educational perspective.
