지적측량 실시기준 및 절차 개선방안 연구 : 경계설정과 면적측정을 중심으로 = Improvement of standards and procedures for cadastral surveys : focusing on boundary setting and planimetry

국문 초록 (Abstract)

오늘날 지적제도는 국토의 효율적인 관리와 국민의 재산권 보호를 실현하기 위해 존재한다. 이러한 시점에서 우리나라 지적측량 관련 법 제도는 토지에 관한 제반 사항을 일반인에게 쉽고 편리하게 제공할 수 있는 기능을 수행해야 한다.
현재 우리나라 지적측량 관련 법 제도는 「공간정보의 구축 및 관리 등에 관한 법률」(같은 법 시행령, 같은 법 시행규칙)과 「지적측량 시행규칙」 외 각종 규정으로 구성되어 있어 지적측량 실시기준과 절차, 경계설정, 면적측정 등에 관한 수행방법이 분리되어 있다. 이로 인해 법 규정들끼리 실시기준과 절차가 중복되고, 과거 지적법의 내용을 토대로 발전됨에 따라 시대적·환경적인 변화를 반영하지 못한 문제가 발생하고 있다.
본 연구에서는 지적측량 관련 법 규정의 해석과 적용에 혼란이 발생하는 문제에 대해 초점을 두어 과거 법 규정과 현재 법 규정의 차이점이 시대에 맞게 개정되었는지 파악하고 지적측량 성과심사자와 지적측량수행자를 중심으로 설문을 수행하여 법 규정의 적합성을 분석하였다.
지적측량 관련 법 규정의 적합성 분석으로 도출된 문제점인 사용하지 않는 측량 장비 실시기준에 관한 문제, 지적측량의 세부측량에 관한 절차 부재 문제, 시행령의 지적측량의 세부적인 경계설정이 미흡한 문제, 지적측량 면적측정에 과거 방법의 구성 문제를 세부적으로 도출하여 사용자 측면에서 지적측량 관련 법 규정을 적용하기 편리할 수 있도록 개선방안을 제시하였다.

The cadastral system today exists to manage South Korea's land efficiently and protect citizens' property rights. From this perspective, cadastral survey laws should function well to provide the general public with all matters concerning land easily and conveniently.
Currently, South Korea's cadastral survey laws consist of various regulations, including the act on the establishment and management of spatial data(enforcement decree of the same act, enforcement rules of the same act), the code of practice of cadastral surveys. The standards and procedures for conducting cadastral surveys, boundary setting, planimetry, among others, are separated. As a result, the standards and procedures of the laws and regulations redundantly overlap, and because it has been developing based on past cadastral laws, it does not reflect changes of the time and the environment, which is becoming problematic.
This study focuses on the problem of confusion occurring during the interpretation and application of cadastral survey statutes and regulations to determine whether the differences between past and current statutes and regulations have been revised in alignment with the times. The suitability of the statutes and regulations were analyzed by conducting a survey centered on cadastral performance reviewers and surveyors.
By analyzing the suitability of the relevant law, problems including the standards and guidelines survey equipment that is not in use, the lack of procedures for detailed surveying of cadastral surveys, the insufficient enforcement ordinance of detailed boundary settings in cadastral surveys, and utilization of past methods for cadastral planimetry were deduced and drawn out in detail. An improvement plan is presented to make it easier for users to apply the cadastral survey laws and regulations.
