학생의 기본권에 관한 몇 가지 문제

다국어 초록 (Multilingual Abstract)

  This article examines the vulnerability to violations of constitutional rights of student(especially secondary school student) and looks into a couple of related issues.<BR>  Students are considered immature as they are under a certain age. Many rules are imposed on them for their protection and education, or to keep order in classrooms. These factors cause weakness in the protection of their constitutional rights. They are minorities in that they are not represented adequately in the political process. Considering the susceptibility to infringement of their constitutional rights, reforms are needed for laws and educational systems which facilitate violations of student constitutional rights. Judicial review should have some teeth through the application of adequate standard of review and fair placement of burden of proof.<BR>  Compulsory religious education in private schools is unconstitutional under our present education system which does not allow school choice. Corporal punishment has to be outlawed to prevent misuse. Excessive hair style regulation can hardly be justified because of the vagueness of its purpose.
