농업인 안전재해보장제도의 통합과 연계방안 연구 - 안전보험의 연계, 보충성, 산재보험과의 연계활용을 중심으로

국문 초록 (Abstract)

농업인들의 안전재해에 대해 민영보험을 운영하는 농협에 위탁관리한다는 선행연구를 전제로 할 때 관련제도 와의 통합과 연계 문제가 제기된다. 통합과 연계에서 우선적으로 논의되어야 하는 것은 산업재해보상보험과 의 연계방안과 다른 사회보험과의 연계 및 어선원보험과 농협의 안전보험의 통합문제이다. 이와 같은 통합과 연계의 목적을 제도와 기구의 조기정착, 비용의 최소화, 보장의 최대화, 관리·운영의 효율화에 둔다고 하면 농 어업안전재해를 산재보험으로의 편입하는 것은 어려우며, 농업의 특성을 고려하지 않는다는 점에서 근로복지 공단이 관리운영한다는 것도 어렵다. 그러나 농어업작업 중 발생한 재해에 대한 보험보호체계를 유지하기 위 해서는 장차 농업인안전보험의 재해판정기준은 현재의 열거주의에서 일반화하여야 하며 그 때는 산재법 제27 조 이하의 재해판정기준과 연계해야 하며, 동시에 장해등급과 장해판정기준은 산재법의 장해등급과 장해판정 기준에 연계하여 통합되고 통일되어야 할 것이다. 그리고 농업인안전보험이나 장차 마련될 농어업인안전재해 보장제도는 산재법의 재활서비스제도와 연계하여 재활을 강화해야 할 것이다. 다른 사회보험과의 관계에서 보충성의 원칙에 따라 농어업인안전재해보험의 요양급여는 국민건강보험의 본 인부담금의 지급을 통해 중복조정되어야 하고, 휴업급여의 지급은 상당한 정도의 국가재정부담과 보험료의 인상을 가져올 수 있기 때문에 농어업인안전재해제도의 조기실현을 위해서는 휴업기간에 대체인건비를 지급 하는 방식으로 보충성의 원칙이 적용되어야 할 것이다. 마지막으로 어선원보험과 농업인안전보험은 당연가입의 공적 보험을 지향해야 한다는 관점에서 통합되어야 하고, 장기적으로는 농어업정책보험을 통합·관리·운영하는 공단이 설립되면 그 공단에 통합되어야 할 것이다.

다국어 초록 (Multilingual Abstract)

This issue is connected with safety & health systems for self-managed farmer, whom the industrial accident insurance don't protect from a accident or a disease in a farm work. National Agricultural Cooperative Federation supply privately-managed voluntary insurance for self-managed farmer. But 49% of the whole farmer doesn't have not a membership for this insurance. Therefore four legislationsinitiatives are moved to the National Assembly. One of the key issues of this initiatives is that National Agricultural Cooperative Federation should be the subject of a management operation. Accordingly, a problem with a unification and a linkage of farm safety and health management systems, specially in the middle of a linkage to the current farm safety insurance, the subsidiarity with the social insurance and the link use to the industrial accident insurance, is brought up currently in the National Assembly. Therefore the author of this work is of opinion that1) the to be introduced farm safety and health management systems should be not whole linked with the industrial accident insurance, but several issues of the industrial accident insurance should be linked with the farm safety and health management systems for a prompt introduction and effektive management of the agricultural accident insurance for self-managed farmer,2) the indication standard of a agricultural accident or a disease should be linked with that of the industrial accident insurance in the form of a generalklausel,3) the grade and the indication standard of the disability benefit disability for self-managed farmer should be linked with that of the industrial accident insurance,4) the subsidiarity with social insurances should be introduced for farm safety and health management systems of self-managed farmer. Therefore medical care expenses of farm safety and health management systems should be excess of National Health Insurance and temporary incapacity benefit of farm safety and health management systems should be expenses for subsititute worker,5) Privately-managed voluntary insurance for self-managed farmer and safety insurance for fishing ship crew, for which government subsidies are supported, should be integrated.
